• <br /> • <br /> ORDINANCE NO. g3 90?- 9,.3 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY <br /> OF SOUTH BEND ESTABLISHING CHARGES FOR NONRECURRING <br /> SERVICES RENDERED BY THE CITY OF SOUTH BEND <br /> WATER WORKS AND AMENDING CHAPTER 17, ARTICLE 4, <br /> SECTION 17-47 OF THE SOUTH BEND MUNICIPAL CODE <br /> STATEMENT OF PURPOSE AND INTENT <br /> The City of South Bend, Indiana, last established a schedule <br /> of rates and charges for services rendered by the South Bend <br /> Water Works by Ordinance Nos . 8305-92 and 8357-93, which were <br /> passed on October 12, 1992, and February 22, 1993, respectively. <br /> The new schedule of rates and charges was approved by the Indiana <br /> Utility Regulatory Commission (IURC) by Order dated January 27, <br /> 1993, in Cause No. 39554 . This new schedule of rates and charges <br /> did not change the previously established charges for certain <br /> nonrecurring services, including disconnect for nonpayment, <br /> reconnection, bad checks, service initiation, frozen meter, <br /> inspection and testing of backflow prevention devices, meter <br /> downsize, and damaged or lost meter. The nonrecurring service <br /> charge for disconnect for nonpayment, reconnection, bad checks, <br /> service initiation, and frozen meter have been in effect for over <br /> twelve (12) years . The nonrecurring service charges for services <br /> rendered in connection with inspection and testing of backflow <br /> prevention devices pursuant to the Cross Connection Control <br /> Program (Ordinance No. 8356-93) , meter downsize, and damaged or <br /> lost meter have not previously been set forth in the Water Works' <br /> schedule of rates and charges, but should be so set forth. <br /> On June 15, 1993, the Board of Water Works Commissioners <br /> adopted Resolution Number 11-1993, finding that the proposed <br /> nonrecurring service charges are nondiscriminatory, reasonable, <br /> and just . The Resolution Number 11-1993 recommended that the <br /> South Bend Common Council enact the nonrecurring charges as set <br /> forth in the proposed amendments to Section 17-47 of the South <br /> Bend Municipal Code. The proposed charges for the aforementioned <br /> nonrecurring services have been filed with the IURC as the <br /> approval of the IURC is necessary before the proposed <br /> nonrecurring service charges may be imposed. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, INDIANA, AS FOLLOWS : <br /> Section I .
