• <br /> • <br /> BILL NO. <br /> ORDINANCE NO. 83 6 - 93 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA,AMENDING CHAPTER 18,ARTICLE 6, SECTION 18-57 OF THE <br /> SOUTH BEND MUNICIPAL CODE BY AMENDING SAID SECTION ADDRESSING <br /> THE PENALTY FOR FAILURE TO DISPLAY ADDRESS STREET NUMBERS,AND <br /> ADDING THE PENALTY TO SECTION 2-213 ADDRESSING SCHEDULE OF <br /> ORDINANCE AND CODE VIOLATIONS <br /> STATEMENT OF PURPOSE AND INTENT <br /> Chapter 18, Article 6 of the South Bend Municipal Code is entitled "House <br /> Numbers". It has been in effect since 1962 and sets forth the address numbering system <br /> utilized by the City. The City Engineer is charged with the responsibility to assign <br /> numbers according to the plan. <br /> Section 18-55 provides that the owner or occupant of every house or business is <br /> required to "place the number assigned to his lot or part of lot by the City Engineer in a <br /> conspicuous place on the side of or above the front door of such house or building." This <br /> section further provides that the numbers be not less than three (3)inches in length and "so <br /> made and marked as to be distinctly and easily read." <br /> Public safety concerns have been raised by the many residential and business <br /> buildings which have no street address on their buildings. Discussions have taken place <br /> with the Police and Fire Departments who believe that street address markings as called <br /> for by current ordinance are not only needed but necessary in order to provide public <br /> safety services to such locations. Additionally, many local taxicab companies have also <br /> voiced concern over the lack of street address markings. <br /> The following ordinance would set forth a monetary penalty provision for failure <br /> to properly have the street address numbers displayed conspicuously on a building. <br /> Proposed paragraph (c)incorporates the current provisions of Section 18-57 and gives the <br /> City additional leverage in seeking compliance by property owners. <br /> It is believed that with the cooperation of the citizens of our City, that they will <br /> make sure that their home or business is in compliance with this public safety requirement. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND,INDIANA, as follows: <br /> Section I. Chapter 18, Article 6, Section 18-57 of the South Bend Municipal <br /> Code shall be amended to read in its entirety as follows: <br /> Sec. 18-57 Penalty for Failure to Display Address Street Numbers. <br /> Anyone violating any of the provisions of this Article may be subject to the following <br /> penalties: <br /> (a) Fifteen Dollars ($15.00) for the first violation as set forth in Section 2-213(a). <br /> Such violation shall be considered an ordinance violation and the fine shall be payable <br /> through the City's Ordinance Violation Bureau. <br /> (b) Twenty-Five Dollars ($25.00) for all subsequent violations in the same <br /> calendar year.
