A RESOLUTION CONFIRMING THE ADOPTION OF A
DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS
WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY
KNOWN AS
Vacant land in the Airport Development area
AS AN ECONOMIC REVITALIZATION AREA FOR
PURPOSES OF A SEVEN-YEAR REAL
PROPERTY TAX ABATEMENT FOR
Olive Cleveland Partners LLC
WHEREAS, the Common Council of the City of South Bend, Indiana, has
adopted a Declaratory Resolution designating certain areas within the City as Economic
Revitalization Areas for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as
vacant land in the Airport Economic Development area ,South Bend, Indiana, and which
is more particularly described as follows:
Kidders Olive Road Minor Subdivision Lot 2
and which has Key Number 025-1011-018601, as an Economic Revitalization Area; and
WHEREAS, notice of the adoption of a Declaratory Resolution and the public
hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5;
and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrance's and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for an economic
revitalization area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
South Bend, Indiana, as follows:
SECTION I. The Common Council hereby confirms its Declaratory Resolution
designating the area described herein as an Economic Revitalization Area for the
purposes of tax abatement. Such designation is for Real property tax abatement only and
is limited to two (2) calendar years from the date of adoption of the Declaratory
Resolution by the Common Council.
SECTION II. The Common Council hereby determines that the property owner is
qualified for and is granted Real property tax deduction for a period of seven (7) years,
and further determines that the petition, the Memorandum of Agreement between the
Petitioner and the City of South Bend, and the Statement of Benefits comply with
Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code
6-1.1-12 et se .
SECTION III. This Resolution shall be in full force and effect from and after its
adoption by the Common Council and approved by the Mayor.

Please find attached the Department of Community & Economic Development's report on a
commercial real property tax abatement petition for the above-referenced petitioner for expansion of
a facility located on vacant land in the Airport Development area. Also attached is a copy of the
petition, Statement of Benefits form, and supporting information.
The report contains the Department's findings relative to the above petition. The petitioner, Olive
Cleveland Partners LLC proposes to construct a 104,000 or 208,000 square foot
warehouse/distribution center which will be leased to Invacare Corporation and DHL. Olive
Cleveland Partners LLC isseeking aseven-year real property tax abatement, and a representative of
Olive Cleveland Partners LLC will be available to meet with the Committee on Monday, August 27,
2007.

On August 14, 2007, a petition for real property tax abatement consideration for property located in
the Airport Economic Development area was filed with the City Clerk by Olive Cleveland Partners
LLC. Pursuant to Chapter 2, Article 6, Section 2-82 of the Municipal Code of the City of South
Bend, this petition was referred to the Department of Community and Economic Development for
purposes of investigation and preparation of a report determining whether the area qualifies as an
Economic Revitalization Area pursuant to I.C.6-1.1-12.1. and whether all zoning requirements have
been met.
The Department of Community and Economic Development has reviewed the petition, investigated
the area, and makes the following report.
PROJECT SUMMARY
Petitioner plans to construct a 104,000 square foot, or 208,000 square foot Class A
warehouse/distribution center in the Airport Economic Development area. The new warehouse will
facilitate the relocation and expansion of Invacare Corporation from 48,000 square feet in 3507
Olive Rd. to 64,000 square feet in the new building. Hilti, Inc. , a current tenant in 3507 Olive Road,
will expand into 8,000 square feet of the old Invacare space. Prospective tenant DHL may occupy
50,000 to 60,000 square feet in the new warehouse and plans to double its workforce, bringing 4 new
employees to this area. The warehouse will be of a modern bulk space design with a clear height of
32 feet which is a new product for the South Bend market. The project will be carried out in two
phases. In each phase, 104,000 square feet of space will be constructed. Timing for construction of
the second phase will depend on market conditions.

Total taxes to be abated during the (7) seven-year abatement period are estimated at $443,233 to
$770,549 depending on the size of the warehouse.. Total taxes to be paid during the (7) seven-year
abatement period are estimated at $334,369 to $581,291 depending on the size of the warehouse. .
EMPLOYMENT IMPACT
Per the petition, it is estimated that the total project will create (4) four new, permanent, full-time
jobs and (0) zero part-time, permanent jobs within the first year representing a new annual payroll of
$102,000. It will maintain 25 existing permanent full-time and 0 existing permanent part-time jobs
with an annual payroll of $690,000. .
ABATEMENT QUALIFICATION
A review of the tax abatements previously granted finds that the petitioner has not been granted
or associated with any previous tax abatements:
2. The Building Commissioner has reviewed the petition and finds the property to be properly
zoned for the proposed project.
3. A review of the South Bend Redevelopment designation areas finds that the property is located
in the Airport Economic Development Area, which is a Tax Incremental Allocation Area;
therefore, the petition for real property tax abatement must first be approved by the South Bend
Redevelopment Commission.
4. A review of the Tax Abatement Ordinance No. 9394-03 finds that the petitioner does meet the
qualifications fora (7) seven-year real property tax abatement under Section 2-79, Warehouse
Developments in the City-wide District.
