NEW BUSINESS (Cont.) <br />9M <br />h. <br />continued... <br />the garage requires the owner of Norwest <br />Bank and Robertson's to execute an <br />Estoppel Certificate confirming that this <br />1965 agreement is still in effect and has <br />not been breached. This agreement <br />ess ntially says that no one will close <br />off the skywalks without the consent of <br />the other parties. <br />Since the Commission now owns the <br />Robertson's Building, the Commission is <br />asked to sign the Estoppel Certificate. <br />However, the doorway to the Robertson's <br />building on the third floor has been <br />closed over with a decorative South Bend <br />Redevelopment Commission <br />doorway/covering. After Robertson's <br />closed, National Bank was the Trust Agent <br />for the building and closed off that door <br />for aesthetic and security reasons. If <br />som one puts the real estate to active <br />use again, Norwest Bank will remove the <br />dec rative covering to the door and allow <br />use of the skywalk again. <br />Upo a motion by Mr. Donoho, seconded by <br />Mrs. Huddleston and unanimously carried, <br />the Commission approved the Estoppel <br />Cer ificate from National Autopark. <br />Mrs. Kolata noted that WAOR wishes to use <br />the Morris Civic Plaza for their concert <br />ser'es on June 19, July 10, July 31, and <br />Aug st 28, 1992. The staff recommends <br />app oving their request pending receipt <br />of 'ndemnification. <br />Upon a motion by Mr. Piasecki, seconded <br />by Mr. Donoho and unanimously carried, <br />the Commission approved the request from <br />WAOZ to use the Morris Civic Plaza on <br />Jun 19, July 10, July 31, and August <br />28, 1992. <br />-7- <br />COMMISSION APPROVED THE ESTOPPEL <br />CERTIFICATE FROM NATIONAL <br />AUTOPARK <br />COMMISSION APPROVED THE REQUEST <br />FROM WAOR TO USE THE MORRIS CIVIC <br />PLAZA ON JUNE 19, JULY 10, JULY <br />31, AND AUGUST 28, 1992 <br />
