O 4e/D- /3 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE <br /> THE CITY OF SOUTH BEND AMENDING ARTICLE 9 OF <br /> CHAPTER 2 OF THE SOUTH BEND MUNICIPAL CODE, <br /> ENTITLED "HUMAN RIGHTS ORDINANCE" <br /> STATEMENT OF PURPOSE AND INTENT <br /> This Ordinance was comprehensively amended in July 1992, among <br /> other reasons, to conform South Bend' s anti-discrimination law to the <br /> federal Fair Housing Act, thereby providing citizens of South Bend with <br /> rights and remedies substantially equivalent to those granted under <br /> federal and state law. However, the South Bend amendments of 1992 did <br /> not include certain specific provisions of the Fair Housing Act, <br /> necessitating further amendment of the Ordinance at this time. <br /> Moreover, when this Ordinance was amended in July 1992, the <br /> definition of "handicapped" was expanded to parallel the definition of <br /> "disability" under the Americans With Disabilities Act (ADA) , yet the <br /> term "handicapped" was retained in South Bend' s Ordinance. Because <br /> federal and Indiana state law uniformly use the terms "disabled" or <br /> "disability, " it is preferable to substitute in this Ordinance the more <br /> uniformly applied term "disabled" for the previously used term <br /> "handicapped. " <br /> This Ordinance, as amended, will fully provide to the citizens of <br /> the City of South Bend the substantial equivalent of rights and <br /> remedies granted under federal and Indiana state law. It will also <br /> substitute the more commonly used terms "disabled" or "disability" for <br /> the previously used term of "handicapped. " <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, as follows: <br /> SECTION I . Chapter 2, Article 9, Section 2-126, 2-127, 2-128, 2- <br /> 129, 2-130, 2-131 and 2-132, of the Municipal Code of the City of South <br /> Bend, Indiana, 1976, Ordinance No. 6003-76, as amended in 1992, <br /> Ordinance No. 8277-92 is hereby amended and reenacted to read as <br /> follows : <br /> Section 2-126 . Short Title. <br /> This article shall be know as the South Bend Human Rights <br /> Ordinance . <br /> Section 2-127 . Purpose. <br /> (a) It is the public policy of the City of South Bend to provide <br /> all of its citizens equal opportunity for education, <br /> employment, access to public conveniences and accommodations, <br /> and acquisition through purchase or rental of real property, <br /> including but not limited to housing, and to eliminate <br /> segregation or separation based solely on race, religion, <br /> color, sex, handicap disability, national origin or ancestry, <br /> and familial status in housing, since such segregation is an <br /> impediment to equal opportunity.
