Section 3. Grievances shall be handled in the following manner: <br />A. The grievances shall be referred to the Union Steward and to the Employer's designee for <br />adjustment. <br />B. If the grievance cannot be settled pursuant to paragraph A of this Section, the grievances shall be <br />referred within five (5) working days to the Field Representative of the Union and the Employer. <br />C. If the grievances cannot be settled pursuant to paragraph B of this Section within three (3) working <br />days the grievances shall be submitted, in care of the Association Director and BAC Local 2 <br />Representative, for Joint Arbitration Board consideration and settlement. <br />D. If the Joint Arbitration Board cannot reach a satisfactory settlement within five (5) working days <br />following a referral of the grievance to the Board, it shall immediately select an impartial arbitrator <br />to review with the Board all evidence submitted relating to the dispute and then cast the deciding <br />vote. If the Joint Arbitration Board cannot agree on an impartial arbitrator, the impartial arbitrator <br />shall be selected from a panel of arbitrators submitted by and in accordance with the rules and <br />regulations of the Federal Mediation and Conciliation Service. All expenses of the impartial party <br />shall be borne equally by the Union and the Employer. All decisions reached by the Joint <br />Arbitration Board at any stage of the grievance shall be final and binding upon all parties. <br />Section 4. When a settlement has been reached at any step of this grievance procedure, such a <br />settlement shall be final and binding upon all parties. <br />Section 5. The time limits specified in any step of the grievance procedure may be waived or expedited <br />by written mutual consent of both parties. Failure to respond within the time limits provided above, <br />without a written request for an extension of time, shall be deemed a waiver of such grievance without <br />prejudice, and shall create no precedent in the processing of and/or resolution of like or similar grievances <br />or disputes. <br />WOURRANINUME <br />F.-JVV,,JXJ21H I a MO a- I I id <br />Section 1. Wages and Fringes. The wages of Apprentices shall be based on percentages of <br />Journeyman scale, plus full (non -reduced) fringe benefits and other contributions and deductions, except <br />Local Dues as noted on the applicable fringe form. <br />The Apprentice rate of pay for Bricklayers ONLY shall be the following percentages of Journeyman scale. <br />1. 0 hours = <br />60% of scale <br />5. <br />3000 hours= <br />80% of scale <br />2, 750 hours = <br />65% of scale <br />6. <br />3750 hours = <br />85% of scale <br />3. 1500 hours= <br />70% of scale <br />7. <br />4500 hours = <br />90% of scale <br />4, 2250 hours= <br />75% of scale <br />8. <br />5250 hours= <br />95% of scale <br />Note: Apprentices must have a minimum of 6,000 hours before completion of apprenticeship; The Joint <br />Apprenticeship & Training Committee (JATC) will determine the final wage increase to Journeyman scale <br />(100%).
