ORDINANCE NO. l ~ ~ s ~"~ <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, REPEALING AND REPLACING THE FOLLOWING <br />PROVISIONS OF THE SOUTH BEND MUNICIPAL CODE, NAMELY CHAPTER <br />21, ARTICLES 1 THROUGH 11, EXCLUDING ARTICLES 6.5 AND 8, WITH <br />THOSE ARTICLES NOT REPEALED BEING RENUMBERED, AND THE <br />INCLUSION OF NEW ZONING MAPS, ALL OF WHICH SHALL BE ENTITLED <br />"THE CITY OF SOUTH BEND ZONING ORDINANCE" <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council of the City of South Bend recognizes its duty to maintain a zoning <br />ordinance which: reflects current trends in development; encourages orderly development <br />for the benefit of the city; provides for a better quality of development; and, promotes the <br />general health, welfare and safety of residents and businesses of the City of South Bend. <br />To that end, the Common Council has given reasonable consideration to, among other <br />things: the comprehensive plan; current conditions and the character of current structures <br />and uses in each district; the most desirable use for which the land in each district is <br />adapted; the conservation of property values throughout the City of South Bend; and, <br />responsible development and growth of the City of South Bend. <br />The Common Council of the City of South Bend, Indiana, further recognizes that since <br />July 2002 a Steering Committee made up of representatives of the Area Plan Commission <br />staff, the South Bend Common Council, the Department of Community and Economic <br />Development, the Public Works Department, and the Building Department has been <br />meeting to work on updating the South Bend Zoning Ordinance. <br />Now, therefore, be it ordained by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />Section I: Chapter 21, Article 6.5 entitled "Historic Preservation Commission" of the <br />South Bend Municipal Code is hereby re-numbered as Article 13 and shall be entitled <br />"Historic Preservation Commission". <br />Section II: Chapter 21, Article 8 entitled "Subdivisions" of the South Bend Municipal <br />Code is hereby re-numbered as Article 14 and shall be entitled "Subdivisions". <br />Section III: Chapter 21, Article 12 entitled "Floodplain Regulations" of the South Be~ul <br />Municipal Code is not repealed and remains numbered as Article 12 and shall remain <br />entitled "Floodplain Regulations". <br />Section IV: The remaining portions of Chapter 21, Articles 1 through 11, except for <br />Article 6.5 and Article 8 which shall re-numbered as set forth in Sections I and II <br />respectively, of the South Bend Municipal Code, are hereby repealed and replaced in their <br />entirety as follows: <br />
