r <br /> . t <br /> Bill No. 96-93 <br /> Ordinance No._3 ?8' ? 3 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA, AMENDING SUBSTITUTE BILL NO. 59-93, FIXING THE <br /> ANNUAL PAY AND MONETARY FRINGE BENEFITS OF FIREFIGHTERS <br /> OF THE SOUTH BEND FIRE DEPARTMENT FOR THE CALENDAR YEARS <br /> 1994, 1995 AND 1996. <br /> Statement of Purpose and Intent <br /> The South Bend Common Council has the responsibility for fixing by <br /> ordinance the annual compensation of all members of the Fire Department <br /> pursuant to Indiana Code § 36-8-3-3 (d) before August 2. <br /> On Thursday, July 29, 1993, the Common Council passed Substitute Bill <br /> No. 59-93 which fixed the annual pay and monetary fringe benefits of <br /> firefighters of the South Bend Fire Department for calendar years 1994, 1995, <br /> and 1996. <br /> On Saturday, July 31, 1993 the respective bargaining committees of the <br /> Firefighters Local Union No. 362 and the City of South Bend continued <br /> negotiations and recommend jointly to their respective bodies the terms of <br /> the following ordinance. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, as follows: <br /> Section I. Section II. of Substitute Bill No. 59-93 also referred to as <br /> Ordinance No. 8397-93 entitled "An Ordinance of the Common Council of <br /> the City of South Bend, Indiana, Fixing the Annual Pay and Monetary Fringe <br /> Benefits of Firefighters of the South Bend Fire Department for the Calendar <br /> Years 1994, 1995, and 1996, is hereby amended by adding to said Section the <br /> following new paragraph (f) which shall read in its entirety as follows: <br /> (f) In the event of a positive ratification vote by the Firefighters Local <br /> Union No. 362 on the total wage, benefit and working conditions package <br /> offered by the City of South Bend, the Sworn Members of the Department as <br /> defined in Section I of Substitute Bill No. 59-93 also referred to as Ordinance <br /> No. 8397-93 shall have the option of selecting one (1) of the following: <br /> 1. Option 1: A one-time CBA Incentive of $600.00 payable in the <br /> second regular payroll check in January of 1994; or <br /> 2.
