BETWEEN MCPHERSON AND LAUREL STREETS <br />THENCE SOUTH 134.475 FT. TO THE NORTHERN MOST PORTION OF THE FIRST <br />EAST/WEST ALLEY BETWEEN LAUREL ST. AND THE NORTH/SOUTH ALLEY <br />Mr. Gilot indicated that Emily Bastine de Hernandez, on behalf of El Campito, Inc., 1024 W. <br />Thomas St., South Bend, IN 46601, has submitted a request to vacate the above referenced alley. <br />Mr. Gilot noted the Fire Department, Police Department, Community Investment, Engineering, <br />and Street Department all recommend in favor of the vacation, which meets the criteria of I.C. <br />36-7-3-13. He advised the Board that Community Investment stated the alley was already <br />vacated back in the 1970's. Engineering agreed but noted there is no Ordinance found <br />confirming the official vacation of the alley. Mr. Eric Horvath, Public Works, requested the <br />Board review the distance listed at 153.8 ft. noting that is incorrect. The Board reviewed the map <br />and confirmed the distance should be corrected to 134.475 ft. Therefore, Ms. Maradik made a <br />motion recommending a favorable recommendation for the request for vacation with the revised <br />description. Ms. Dorau seconded the motion which carried. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHT TO REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of the following Consent to Annexation and Waiver <br />of Right to Remonstrate. The Consent indicates that in consideration for permission to tap into <br />public water/sanitary sewer system of the City, to provide water/sanitary sewer service to the <br />below referenced property, the applicant waives and releases any and all rights to remonstrate <br />against or oppose any pending or future annexations of the property by the City of South Bend: <br />
