While this is a local decision, the <br />failure to progress in the implementation of <br />the project may be considered a violation of <br />the UMTA grant agreement. Part II, Section <br />106, of the UMTA contract states in part "Any <br />failure to make progress or other violation of <br />the Agreement which significantly endangers <br />substantial performance of the Project within <br />a reaso able time shall be deemed to be a <br />breach f the terms of this Agreement ". <br />Please provide an implementation schedule <br />to UMTA for the downtown transfer facility. <br />Implementation of this project should be <br />undertaken within 90 days or UMTA will <br />consider the SBPTC in breach of the grant <br />agreeme t. <br />Yo Jr immediate attention to this matter <br />is appr ciated. <br />Sincerely, <br />Donald F.
