ARTICLE I <br /> Definitions and Exhibits <br /> Section 1. 1. Terms Defined. In addition to the words and <br /> terms elsewhere defined in this Mortgage, the following words and <br /> terms shall have the following meanings unless the context clearly <br /> otherwise requires: <br /> "1986 Bonds" means the city of South Bend, Indiana Economic <br /> Development Revenue Bond, Series 1986 (P.A.I. Properties Project) , <br /> dated December 15, 1986, issued in original principal amount of <br /> $722, 000. 00 pursuant to the 1986 Indenture. <br /> "1986 Indenture" means the Trust Indenture between City of <br /> South Bend, Indiana, and 1st Source Bank, as Trustee, dated as of <br /> December 15, 1986. <br /> "1986 Loan Agreement" means the Loan Agreement and Security <br /> Agreement between the Borrower and City of South Bend, dated as of <br /> December 15, 1986. <br /> "1986 Notes" means the "Notes", as defined in the 1986 Loan <br /> Agreement. <br /> "Act" means Indiana Code 36-7-11.9 and 36-7-12 , as amended. <br /> "Additional Bonds" means the additional parity Bonds <br /> authorized to be issued by the Issuer pursuant to Section 208 of <br /> the Indenture and any Bonds issued in substitution or replacement <br /> therefor. <br /> "Additional Notes" means the additional parity Notes <br /> authorized to be issued by the Borrower pursuant to the provisions <br /> of Article VI hereof. <br /> "Bond Counsel" means a nationally recognized firm of municipal <br /> bond attorneys acceptable to the Trustee. <br /> "Bonds" means the Series 1993 Bonds, the Additional Bonds and <br /> any other Bonds issued under the Indenture. <br /> "Bond Fund" means the Bond Fund established by Section 402 of <br /> the Indenture. <br /> "Borrower" means, P.A.I. Properties, an Indiana partnership, <br /> the general partners of which are Noel H. Yarger and G. Toms <br /> Yarger, its successors or assigns or any surviving, resulting or <br /> transferee partnership or corporation. <br /> -5- <br />
