Cod mission approval requested for an amendment <br />to the Lease between the Redevelopment <br />Commission and South Bend Parking Company, <br />Inc., dated April 28, 1982, for Lots No. 50, <br />51, and 52 located in the Central Downtown <br />UrIz an Renewal Area. <br />Mr. Nimtz noted that that this item was added <br />to the agenda. <br />Mr. Richard Hill, City Attorney, noted that <br />there has been ongoing litigation between the <br />Conmission and South Bend Parking on the <br />possession of Lots No. 50, 51, and 52, more <br />co only referred to as the Penney's lot. The <br />issues involved in the litigation have held up <br />th closing of the property for the One <br />Mi hiana Square project. The City Attorney's <br />office has negotiated a resolution of the <br />issues and recommend an amendment to the <br />pr sent lease that would allow South Bend <br />Pa king to continue use of the lot as a <br />surface lot pending a sale by the Commission <br />to a developer. Continguent upon execution of <br />th lease for the Penney's lot, the Commission <br />would take im- nediate possession of the One <br />Mi hiana Square property. This action would <br />allow the Commission to proceed with closing <br />on property and also allow release of the UDAG <br />grant relating to that project. <br />Ms. Schwartz explained that the execution of <br />the amendment to the existing Lease would <br />occur only after the following events have <br />occured. <br />1. <br />Payment by South Bend Parking of all rent due <br />and owing to the Commission on the above <br />premises and on Lot No. 7 of the River Bend <br />Addition to the City of South Bend. <br />-3- <br />THERE WERE NO COMMUNICATIONS <br />THERE WAS NO OLD BUSINESS <br />
