shall be deemed references to the Issuer. <br /> (b) In determining whether any default or lack of compliance by the Borrower exists <br /> under this Agreement, the Trustee shall not be required to conduct any investigation into or <br /> review the operations or records of the Borrower and, absent actual knowledge of any default or <br /> noncompliance, may assume compliance by the Borrower with this Agreement unless otherwise <br /> specifically notified in writing. <br /> (c) The permissive right of the Trustee to take actions permitted by this Agreement <br /> shall not be construed as an obligation or duty to do so. <br /> (d) The Trustee shall be under no duty to confirm or verify any financial or other <br /> statements, reports or certificates furnished pursuant to any provisions hereof, and shall be under <br /> no other duty in respect of same except to retain the same in its files and permit the inspection of <br /> same at reasonable times by the Issuer. <br /> (e) The Trustee has the right to appoint agents to carry out any of its duties and <br /> obligations hereunder, and shall, upon request, certify in writing to the other parties hereto any <br /> such agency appointment. <br /> SECTION 20. Incorporation of Rider.
