• , ORDINANCE NO. AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: The first north-south alley east of N. Cottage Grove Avenue from the south line of Lot 1 (Klingel ' s Subdivision of Heintzman' s Ad- dition) to the south right-of-way line of W. Grandview Avenue for a distance of approximately 132. 8 ft. and a width of approximate- ly 13 . 86 ft. Alley located in Heintzman' s Addition and Klingel ' s Subdivision of Heintzman' s Addition to the City of South Bend. Also, West Grandview Avenue from the east right-of-way line of N. Cottage Grove Ave. to the southwest right-of-way line of Lincoln Way West (U.S . 20) for a distance of approximately 249.7 ft. and a width of approximately 62 ft; part located in Heintzman' s Addi- tion and Bank Out Lot 130 in the City of South Bend, Indiana. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows : SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the fol- lowing property: The first north-south alley east of N. Cottage Grove Avenue from the south line of Lot 1 (Klingel ' s Subdivision of Heintzman' s Ad- dition) to the south right-of-way line of W. Grandview Avenue for a distance of approximately 132. 8 ft. and a width of approximate- ly 13. 86 ft. Alley located in Heintzman' s Addition and Klingel ' s Subdivision of Heintzman' s Addition to the City of South Bend. Also, West Grandview Avenue from the east right-of-way line of N. Cottage Grove Ave. to the southwest right-of-way line of Lincoln Way West (U. S. 20) for a distance of approximately 249.7 ft. and a width of approximately 62 ft; part located in Heintzman' s Addi- tion and Bank Out Lot 130 in the City of South Bend, Indiana, hereby determines that it is desirable to vacate said property.
