As you know, state law (IC § 36-7-4-603) specifies five criteria to evaluate a <br />rezoning: 1) comprehensive plan, 2) current conditions and character of current structures <br />and uses, 3) most desirable use, 4) conservation of property values, and 5)responsible <br />development and growth. <br />The Plan Commission staff report made a compelling case that this rezoning does not meet <br />these criteria. The Plan Commission, comprised of community members, land use experts, <br />the City Engineer and a Council representative, voted unanimously(9- 0) to send an <br />unfavorable recommendation to the Common Council. The zoning and annexation <br />committee also sent an unfavorable recommendation to the full Council. For these reasons <br />and the lack of a compelling case under the criteria, please accept this as notice of my veto. <br />My administration and appointees to the Plan Commission aggressively support growth <br />and development in our city. If they can justify an action under the state criteria, I'm <br />confident they will find a way to be supportive of investment in our community. <br />Conversely, they will not make unfavorable recommendations lightly. I hope in the future <br />that there can be more discussion before voting against their recommendations. <br />Although Council could choose to pass this ordinance over my veto, I hope you will take a <br />closer look and reconsider.
