As you know, state law (IC § 36-7-4-603) specifies five criteria to evaluate a <br /> rezoning: 1) comprehensive plan, 2) current conditions and character of current structures <br /> and uses, 3) most desirable use, 4) conservation of property values, and 5)responsible <br /> development and growth. <br /> The Plan Commission staff report made a compelling case that this rezoning does not meet <br /> these criteria. The Plan Commission, comprised of community members, land use experts, <br /> the City Engineer and a Council representative, voted unanimously(9-0) to send an <br /> unfavorable recommendation to the Common Council. The zoning and annexation <br /> committee also sent an unfavorable recommendation to the full Council. For these reasons <br /> and the lack of a compelling case under the criteria, please accept this as notice of my veto. <br /> My administration and appointees to the Plan Commission aggressively support growth <br /> and development in our city. If they can justify an action under the state criteria, I'm <br /> confident they will find a way to be supportive of investment in our community. <br /> Conversely, they will not make unfavorable recommendations lightly. I hope in the future <br /> that there can be more discussion before voting against their recommendations. <br /> Although Council could choose to pass this ordinance over my veto, I hope you will take a <br /> closer look and reconsider.
