Byorni Executive Director Assistant Director Phone 574 235 -9571 Fax 574 235 -9813 December 17, 2003 The Honorable Council of the City of South Bend 4th Floor, County-City Building South Bend, IN 46601 RE: A proposed ordinance initiated by the Common Council of the City of South Bend to zone from "A" Residential, "A" Height and Area; "C" Commercial, "A" Height and Area; "C -1" Commercial, "A" Height and Area; "D" Light Industrial, "A" Height and Area; and, "E" Heavy Industrial, "C" Height and Area to "CB" Community Business District, property located at the southwest corner of South Michigan Street and Ireland Road, running west along Ireland Road, approximately 2,250 feet and south to the U.S. 31 North Bypass, City of South Bend - APC# 2238 -03 Dear Council Members: The above referenced ordinance of initiated by the Common Council of the City of South Bend was legally advertised on Thursday, December 4, 2003. The Area Plan Commission at its public hearing on Tuesday, December 16, 2003, took the following action: Upon a motion by Robert Hawley, being seconded by Charlotte Sobel and unanimously carried, the proposed ordinance initiated by the Common Council of the City of South Bend to zone from "A" Residential, "A" Height and Area; "C" Commercial, "A" Height and Area; "C -1" Commercial, "A" Height and Area; "D" Light Industrial, "A" Height and Area; and, "E" Heavy Industrial, "C" Height and Area to "CB" Community Business District, property located at the southwest corner of South Michigan Street and Ireland Road, running west along Ireland Road, approximately 2,250 feet and south to the U.S. 31 North Bypass, City of South Bend is sent to the Common Council with a favorable recommendation. In the commission's opinion, with the surrounding industrial and commercial uses in the area, this location is appropriate for the "CB" Community Business District. The "CB" District requires more stringent development standards, such as landscaping and architectural standards, while allowing the big box types of developments that are currently being contemplated for the south side of the city.
