STAFF REPORT <br />Initiated by the Common Council of the City of South Bend 2238 -03 <br />Location: The southwest corner of U.S. 3 l and Ireland Road <br />City of South Bend <br />REQUESTED ACTION: The petitioner is requesting a zone change from "A" Residential, "A" <br />Height and Area; "C" Commercial, "A" Height and Area; "C -1" <br />Commercial, "A" Height and Area; "D" Light Industrial, "A" Height <br />and Area; and, "E" Heavy Industrial, "C" Height and Area to "CB" <br />Community Business District to allow a retail and service shopping <br />center and related uses. <br />EXISTING LAND USE: The property contains single- family homes, offices, a fire station, <br />commercial and industrial uses. <br />SURROUNDING LAND <br />USE AND ZONING: Located to the north are single- family homes zoned "A" Residential, <br />"A" Height and Area, commercial uses zoned "C" Commercial, "A" <br />Height and Area, and industrial uses zoned "E" Heavy Industrial, "A" <br />Height and Area, To the south is the Bypass and utilities zoned "D" <br />Light Industrial, "A" Height and Area. To the east are commercial uses <br />zoned "C" Commercial, "A" Height and Area. To the west are <br />industrial uses zoned "E" Heavy Industrial, "C" Height and Area. <br />ACCESS: Access to the site has not been addressed. <br />WATER SOURCE/ <br />SEWAGE DISPOSAL: Water and sewer are available to the site. <br />DRAINAGE: The drainage has not been addressed by the petitioner. <br />SITE DATA: The total site to be rezoned is approximately 62 acres. <br />ENVIRONMENTAL <br />DATA: A check of the Agency's maps indicates that no public wells or <br />wetlands are present. Part of this site appears to be in or near the 100 <br />year flood plain. The inactive St. Joseph County (Bendix) land fill is <br />located on this site. <br />SITE PLAN: A site plan is not required for rezonings initiated by the Common <br />Council. <br />AGENCY COMMENTS: The City Engineer has not made any comments. <br />STAFF <br />RECOMMENDATIONS: Based on information available prior to the public hearing, the staff <br />recommends that this petition be sent to the Common Council with a <br />favorable recommendation. In the staffs opinion, with the surrounding <br />industrial and commercial uses in the area, this location is appropriate <br />for the "CB" Community Business District. The "CB" District requires <br />more stringent development standards, such as landscaping and <br />architectural standards, while allowing the big box types of <br />developments that are currently being contemplated for the south side <br />of the city. <br />
