South Bend Redevelopment Commission
Regular Me ting - March 20, 1981
5. PUBLICIHEARING (continued)
Mr. West replied that that is after the fact. I am talk -
ing about the.present, now. I cannot exist the next two
years if what is going to happen happens today. Being
that you are a businessman too, I am quite sure you under-
stand what I am saying. I do not want to get lost in the
shuffle on this resolution based upon something you tell
me you are going to do in the future, and that future is
mailing my letter to HUD.
Mr. Ninitz said he wanted to make something clear. You are
asking us to do certain things and I have told you I don't
know if we can legally do them or not. My position on
this Commission has been that we are audited by HUD and we
do not spend money unless we can legally do so. I am not
going to get out on a limb here to do something which you
have asked us to do. You indicated that you have talked
with H D and they say that we can do it. We will forward
your 1 tter to HUD, if the other Commissioners agree, and
see wh t the recommendations are
Mr. West explained that he did not ask Mr. Nimtz to do
anything. It was Mr. NImtz that questioned taking the
letter to HUD. The only thing that I am asking you to do
here today is to hold off on this resolution until everyone
in that area is satisfied with the resolution. I am not
satisf ed with the present plan as it stands now. I am
asking the Commission to consider that as opposed to pass-
ing th resolution and passing me over as if I don't exist.
Mr. Donaldson asked what effect passing this resolution
would ave on Mr. West's statement and what he is asking.
Mr. Butler responded that there is no problem with whatever
action is taken today. The basic Urban Renewal Plan in-
cludes the parcels that have been designated for acquisition
and can be amended subsequently. As a matter of fact, in
every project the Commission has had there have been numerous
amendatory resolutions accomplishing just that.
Mr. Do4aldson questioned whether the passing of this resolu-
tion would have any affect one way or another.
Mr. Butler replied that it would not foreclose the Commis-
sion s bsequently taking action to either in whole or in
part accommodate Mr. West.
Mr. Donaldson said that if he is reading Mr. Infest right,
what 1,9 . West is saying is that if this resolution is passed
today, that automatically will knock them out.
22
