South Bead Redevelopment Commission <br />Regular Teeting January 18, 1980 <br />Mr. ill: I think it is, obviously Kirchner <br />Moore is a not - for - profit group, and they are <br />in it for the fiscal return to them. Yester- <br />day in talking with Mr. Goemans he felt very <br />positive about the outcome of our test liti- <br />gation. It is their feeling that based on <br />the amendments that have been introduced, <br />the cutcome of the litigation will be very <br />positive, so Kirchner Moore is feeling very <br />positive about the prospect of being able <br />to use the statute. <br />Mayo,r Parent: I might add that there is a <br />difference here between feeling positive <br />about the statute and the process that we <br />may have to go through. That doesn't <br />necessarily mean that the Century Mall <br />Project will occur. As you will know <br />there are a number of decisions and pit- <br />falls along the way, and I just want to <br />add a note of caution. We are obviously <br />proceeding under the assumption that every- <br />thing will go very well and that in a year <br />or so the financing capabilities will be <br />completed. There are a lot of factors <br />consi Bred in this project. This is a <br />good iote as Mr. Hill suggested and we are <br />very pleased with the results of the meeting <br />that Senator Hunt called. We have a lot to <br />thank him for; he has been very helpful in <br />moving us along. <br />Mr. derson: What you are trying to say <br />here Ls that this is one hurdle which could <br />have cilled this project before it even got <br />off the ground. <br />MayorlParent: That is correct. <br />Mr. N tz: I think everyone understands that <br />when we talk about a court suit we are talking <br />about a friendly court suit. We get a friendly <br />plaintiff to file an action contesting the <br />validity of the statute and that is where you <br />get a determination up through the Court of <br />Appeals to the Supreme Court. This is a long <br />process and we hope to get it done within a <br />year, because there are no intentional road <br />blocks; everybody cooperates in order to get <br />the Court to make a decision. <br />Ms. D rbeck: I take it then that this Court suit <br />is going to be based on the Century Mall situation? <br />ME <br />
