PUBLIC WORKS AND PROPERTY VACATION SEPTEMBER 10,2012 4:23 P.M. Committee Members Present: Dr. David Varner, Oliver Davis, Gavin Ferlic, Valerie Schey Other Council Members Present: Tim Scott, Henry Davis, Dr. Fred Ferlic, Karen White, Derek Dieter Others Present: Mike Schmuhl, Tim Sexton,Mark Lyons, Gary Gilot,Jitin Cain, Kevin Allen, Kathy Cekanski-Farrand, Christa Nayder, Mike Danch, Scott Kidder Agenda: Bill No. 40-12—Vacate Alley Notre Dame Avenue/Howard Bill No. 41-12—Correct Legal Description The first item, Bill No. 40-12, an appeal to vacate a portion of an alley was brought to the Council by Scott Kidder, an adjoining property owner who was representing nearby effected residents. Before Mr. Kidder's presentation, Gary Gilot, Director of Public Works reported that the request to vacate had passed scrutiny of all city departments and was favorably recommended by the Board of Public Works. Mr. Kidder proceeded to explain the request primarily based on safety concerns for kids playing in unfenced rear yards. He had a handout(A copy is on file in the Office of the City Clerk)to illustrate the request. Henry Davis questioned the consistency of alley vacation allowances city-wide. Derek Dieter wondered what was the City's overall alley vacation policy. Dr. Fred Ferlic expressed support. On a motion by Valerie Schey, seconded by Oliver Davis,the bill was sent to full Council with a favorable recommendation. Bill No. 41-12. This bill presented by Mike Danch for the City merely corrected minor legal description errors in previously passed ordinance 10144-12. There were no questions. Oliver Davis motion the bill be sent favorably. Valerie Schey seconded and all agreed.
