Butler: We have to be testifying, to our appraisal figure and their appraisers are going to be submitting evidence at a higher figure. We are not using the $82,920.00 figure. That was simply the Tount that we had to deposit into the c urt. Those appraisers will not appear i court and testify. Nimtz: Quite some time ago, one praiser testified he had been appointed the court and that of course caused immediate mistrial and they had to start 1 over. The staff has discussed this th me and with Mr. Butler and it is my eling that the attorney's fees and the es you pay the appraisers including other penses, you might just as well pay the gure you began with. Butler: We start at the $91,500.00 figure. jury is going to at least award this ,unt because this is the amount our raisers are going to testify to. Of course W. Nimtz indicated,there would be the art costs, attorney's fees, etc. . Nimtz: It is the Chair's recommendation at we approve the $91,500.00 figure for e Zondervan Bookstore.
