I think it <br />would be unfair for the Commission to say that no further <br />policies will be written or asked of Michiana Title if Mr. <br />Butler is no longer the attorney for the Commission, but I <br />think vre should make a motion that as long as Kevin Butler <br />is the Chief Legal Counsel for the Redevelopment Commission <br />the st ff will not order any further title work from Michiana <br />Title �ompany. Do I hear such a motion? <br />Mr . i a: I have a question.. If Kevin's firm is in compe- <br />titioCn as a sealed bid, why wouldn't they be allowed to <br />bid on it? <br />Mr. Ni�tz: Well, he's willing to agree to this. I agree <br />with y u, but Kevin is agreeable to this arrangement. <br />Mr. Ci a: In the future, something of this nature may come <br />up again in some other situation. I don't think it should <br />be allowed.. <br />Mr. Butler: I appreciate what you are saying, but I think <br />there s no need for even a semblance of conflict of interest, <br />which 's the term, that has been used. We're really talking <br />about 'nside advantage, using position for unfair advantage. <br />There s no need for even a semblance of that. As I say, <br />this m tter brings that quite clearly home to all of us. <br />Mr. Ni tz: Do I hear a motion? It is the recommendation of <br />the Chair that in light of the resolution of this issue with <br />the Ab tract Company of St. Joseph County, that there really <br />is no conflict of interest and the Chair would entertain a <br />motion that Kevin Butler be retained as Chief Legal Counsel <br />of the Commission. <br />A motion was made by Mr. Donaldson, seconded by Mr. Robinson, <br />to ret in Kevin Butler as Chief Legal Counsel for the Commis - <br />sion a d as long as he is the Attorney, no future orders for <br />title insurance would be given by the Commission or the <br />Bureau of Housing to Michiana Title Corp., and was unanimously <br />carried. <br />Mr. Ro inson: I'm inclined to agree with Bob. Also, I think <br />that ir this case that Kevin, because I'm sure the Mayor got <br />some hat from the general public about this when it was <br />broughi to their light and was spread on the face of the news- <br />paper and all the television stations, I think he was tried <br />and hung before he even had a trial. I think it's unfair <br />and I think Kevin has done a fine job, and kept us all out <br />of jai'.
