First.hearing on.Vacation Resolution No. 5 passed on July 23, 1901. No remonstra- <br />tors appeared. The Board declare the following property vacated: -"All that part of Baker <br />street which lies east of the east line of College street and running east.ninety one and <br />one fourth(91 1/4) feet from said east line to the west line of a sixteen(16) foot alley <br />on the east side of Lot 40 in College Grove Addition to the City of South Bend, which all- <br />ey the Indiana, Illinois and Iowa Railway Company propose to open". Vacation Resolution is <br />hereby confirmed. The roll of interested property owners, who might have been injurouisly <br />or beneficially affected by the above vacation, being already in the hands of this Board, <br />this board hereby determine the questions of benefits and damages as follows:- The board <br />find that no person has been damaged by the vacation and that the Indiana, Illinois and <br />Iowa Railway has been benefitted by the vacation. But inasmuch as said Railway Company has <br />dedicated a piece of land to the City of South Bend for public use and highway purposes ; <br />the Board find that no assessments for benefits should be made against said RailwaytCom- <br />parry. Said Railway Company have dedicated as heretofore mentioned the following described <br />property:- A perpetual easement over and upon sixteen feet(16) off of the east side of the <br />entire length of Lot Number Forty (40) in College Grove Addition to the City of South Bend <br />for highway porposes for the use of the public generally. <br />President. <br />
