First.hearing on.Vacation Resolution No. 5 passed on July 23, 1901. No remonstra- tors appeared. The Board declare the following property vacated: -"All that part of Baker street which lies east of the east line of College street and running east.ninety one and one fourth(91 1/4) feet from said east line to the west line of a sixteen(16) foot alley on the east side of Lot 40 in College Grove Addition to the City of South Bend, which all- ey the Indiana, Illinois and Iowa Railway Company propose to open". Vacation Resolution is hereby confirmed. The roll of interested property owners, who might have been injurouisly or beneficially affected by the above vacation, being already in the hands of this Board, this board hereby determine the questions of benefits and damages as follows:- The board find that no person has been damaged by the vacation and that the Indiana, Illinois and Iowa Railway has been benefitted by the vacation. But inasmuch as said Railway Company has dedicated a piece of land to the City of South Bend for public use and highway purposes ; the Board find that no assessments for benefits should be made against said RailwaytCom- parry. Said Railway Company have dedicated as heretofore mentioned the following described property:- A perpetual easement over and upon sixteen feet(16) off of the east side of the entire length of Lot Number Forty (40) in College Grove Addition to the City of South Bend for highway porposes for the use of the public generally.
