ORDINANCE NO. erS,.7O - ? 9. <br /> AN ORDINANCE OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, APPROVING <br /> THE SALE OF PARK PROPERTY <br /> STATEMENT OF PURPOSE AND INTENT <br /> The City of South Bend, Indiana, for the use and benefit of <br /> its Park Department and/or Board of Park Commissioners <br /> (hereinafter, the "Park Department") owns certain real property <br /> located at Elbel Golf Course, and being more particularly <br /> described at Exhibit "A" hereto, (hereinafter, the "Real <br /> Property") . Pursuant to I .C. 36-10-4-9 (a) , said lands are under <br /> the exclusive control of the Board of Park Commissioners of the <br /> Park District of the City of South Bend (hereinafter, the "Park <br /> Board") . <br /> The Real Property is vacant land, adjacent to the property <br /> that formerly served as housing for the Elbel Golf Course golf <br /> professional . The Real Property is no longer needed for park <br /> purpose. <br /> At its meeting of April 18, 1994, the Park Board determined <br /> that the Real Property is not required for park purposes and <br /> authorized the sale of the Real Property upon the following <br /> conditions : <br /> A. That the Real Property be sold at a price not less <br /> than its appraised fair market value. <br /> B. That all proceeds of the sale of the Real Property <br /> be returned to the Park Board and used for park purposes . <br /> By Ordinance No. 8498-94, the Common Council approved the <br /> sale of the Real Property. <br /> Pursuant to I .C. 36-1-11, the Board of Public Works for the <br /> City of South Bend conducted a public sale of the Real Property <br /> and recommended acceptance of the bid of William J. Krizman. <br /> Said recommendation has been approved by the Mayor. <br /> Pursuant to I .C. 36-11-1-3, Common Council approval of the <br /> Sale of the Real Property is required. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, INDIANA, AS FOLLOWS : <br /> Section I . The sale of the Real Property to William J. <br /> Krizman for the sum of $20, 000 and in accordance with the terms <br /> of the offering, is approved, subject to the following <br /> conditions : <br /> A. That no environmental testing will be performed or <br /> paid for by the City and that the Real Property will be sold <br /> as is . <br /> B.
