PROGRESS REPORTS (Cont'd) <br />Mr. Dave Anderson: Mr. Ellison, you are saying that HUD appears to <br />be confident that the litigation pending down state, whether it is <br />from tie Supreme Court or the Court of Appeals appear confident <br />that tie Redevelopment Commission will win that lawsuit? <br />Mr. Ellison: I didn't mean to imply that. HUD is aware that there <br />is litigation, but HUD of course, has no position on that. HUD is <br />apparently, by their actions, confident that the locality, can in fact, <br />execute project. That is the confidence I spoke of. HUD considers the <br />litigation a local matter. <br />Mr. An erson: HUD would routinely release money for projects whether <br />they are under litigation or not, and by doing so, there is no <br />reflec ion on the quality of the case or any other matters that may enter <br />into tie problems here. <br />Mr. E1 ison: That is correct. Sometimes HUD might have cause not to <br />releas funds if they are a party to the suit, or if they feel that the <br />federa interest in the project would somehow be jeopardized. <br />8. ADJOURNMENT ADJOURNMENT <br />There being no further business to come before the Commission, <br />Mr. Dotialdson made a motion that the meeting be adjourned, seconded <br />by Mr. Robinson, and the motion was unanimously carried.
