BILL NO. ��// -7�j �} <br /> ORDINANCE NO. 35 /O -95 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA,AMENDING CHAPTER 2,ARTICLE 8, SECTION 2-124 OF THE <br /> SOUTH BEND MUNICIPAL CODE ADDRESSING RETIREMENT GIFTS FOR <br /> PUBLIC SAFETY SWORN PERSONNEL. <br /> STATEMENT OF PURPOSE AND INTENT <br /> The Common Council acknowledges that on January 11, 1988, it passed <br /> Ordinance No. 7847-88 establishing a gift policy for South Bend Police Officers who <br /> retire with 20 or more years of dedicated service to the City of South Bend. <br /> The Common Council further acknowledges that on October 12, 1994, the Board <br /> of Public Safety adopted Resolution No. 38-1994, and that the Board of Public Works <br /> approved on October 17, 1994, policies entitling Fire fighters who retire with 20 or more <br /> years of active service with the South Bend Fire Department would be entitled to keep his <br /> or her own fire helmet. <br /> After discussion with the City Administration and input from the respective Chief's <br /> of the Fire and Police Departments and the sworn personnel within both departments, the <br /> Common Council believes that the following Ordinance is necessary to clarify procedures <br /> for retiring sworn members of the Fire and Police Departments with 20 or more years of <br /> service. <br /> The Common Council believes that this gift retirement policy is an appropriate <br /> tribute to each of the individuals who have dedicated 20 or more years of service to the <br /> City of South Bend. <br /> riot Irljerefort, be it ortrainetr by the Common Council of the City of <br /> 'out j Ifientr, Intriat1U, as follows: <br /> Section I. Chapter 2 Article 8, Sec. 2-124 of the Municipal Code of the City of <br /> South Bend,Indiana,is amended to read in its entirety as follows: <br /> Sec.2-124 Addressing Retirement Gifts for Public Safety Personnel. <br /> (a) The City of South Bend, Indiana believes that a retirement gift policy <br /> for sworn members of the Police Department and Fire Department respectively is a fitting <br /> tribute of appreciation for the dedicated service provided to the City by such individuals. <br /> (b) Upon retirement with twenty (20) or more years of service to the City <br /> of South Bend, Indiana, a sworn member of the South Bend Fire Department shall be <br /> entitled to retain as his or her own personal property, the fire helmet used by such Fire <br /> Fighter immediately prior to giving notice of his or her retirement. <br /> (c) Upon retirement with twenty (20) or more years of service to the City <br /> of South Bend, Indiana, a sworn member of the South Bend Police Department shall be <br /> entitled to retain as his or her own personal property, the Department issued weapon or <br /> sidearm which said sworn member was using immediately used prior to giving notice of <br /> retirement. <br /> (d) The appropriate Board(s) of the City of South Bend shall make a <br /> specific determination that said retiring Fire Fighter or Police Officer seeking to retain said <br /> helmet or said weapon/sidearm is retiring in good standing, and that his or her proposed <br /> retirement gift is determined to be surplus property and no longer useful to the City. <br /> (P) The recnPrtivP PPncinn RnarA of pat.!, ripnartmarnt harahv o„th.,r;oa.a <br />
