Mower NO. EL -94 <br /> SUBSTITUTE BILL NO. 120-94 <br /> AN ORDINANCE TO VACATE THE FOLLOWING <br /> DESCRIBED PROPERTY <br /> Keasey Street from Michigan Street to Carroll Street. Some north/south and east/west <br /> alleys situated between Michigan Street and Carroll Street, and Ohio Street and <br /> vacated Elder Street. All more particularly described as follows. <br /> STATEMENT OF PURPOSE AND INTENT <br /> Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the <br /> authority to hear all petitions to vacate public ways or public places within the City. <br /> The following ordinance vacates the above described public property. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br /> OF SOUTH BEND, INDIANA, as follows: <br /> SECTION I. The Common Council of the City of South Bend having held a public <br /> hearing on the petition to vacate the following property: <br /> Description of Vacation of a 14' Wide Alley <br /> A parcel of land located in the Northwest Quarter (NW %) of Section Thirteen (13), <br /> Township Thirty-Seven (37) North, Range Two (02) East and all being in Portage <br /> Township, City of South Bend, St. Joseph County, Indiana and as shown on the <br /> following subdivision plats; Elder Place - Book 5, Page 13, Joseph Keasey - Book 2, <br /> Page 69 and Adam S. Baker's 1st Addition to the City of South Bend - Book 4, Page <br /> 35, said parcel being a 14 foot wide public alley and being 7.0 feet each side of the <br /> following described centerline: <br /> Commencing at the intersection of the east right-of-way line of a public street now <br /> known as Michigan Street and the north right-of-way line of a vacated public street <br /> now and formerly known as Elder Street, said point of intersection also being the <br /> southwest corner of Lot "B" as shown on the Plat of Elder Place - Book 5, Page 13 in <br /> the Office of the St. Joseph County Recorder; thence east, along the north right-of- <br /> way line of said vacated Elder Street, a distance of 155.5 feet, more or less, to the <br /> centerline of a fourteen foot (14') wide alley, said point being the Point of Beginning of <br /> this centerline description, thence north along the centerline of said fourteen foot (14') <br /> wide alley, a distance of 236.0 feet, more or less, to a point on the south right-of-way <br /> line of a public street now known as Keasey Street and being the terminus of this <br /> description. <br /> Also, <br /> A parcel of land located in the Northwest Quarter (NW 1/4) of Section Thirteen (13) <br /> Township Thirty-Seven (37) North, Range Two (02) East and all being in Portage <br /> Township, City of South Bend, St. Joseph County, Indiana and as shown on the <br /> following subdivision plats; Elder Place - Book 5, Page 13, Joseph Keasey - Book 2, <br /> Page 69 and Adam S.
