CITY OF SOUTHBEND COMMUNITY INVESTMENT January 7, 2020 Dear Members of the Board of Public Works, The week end after Christmas, DCI's property inspector Jeff Young checked the former Salvation Army building to make sure it was secure and the mechanicals were functioning properly. He noticed the southern two story section of the building was cold and checked the boiler, which had overheated and was no longer operating. This two story section supplies the one story northern section its water supply and sewer line, so it must be heated. The northern section currently houses the City's Weather Amnesty program, and not having water or sewer service endangers the life and health of the people the Weather Amnesty program serves during the coldest months of the year. Jeff contacted EJ White to inspect the boiler, and it was discovered sediment in the system had clogged valves and overheated the system to the point the entire system needs replaced. Section 14.5-6 of the Municipal Code (the Inclusive Procurement and Contracting ordinance) allows for emergency contracting conditions, defined in Section 14.5-2(q) as "a contract that is awarded on an emergency basis due to a threat of harm to person or property or threat of disruption of government services." Additionally, State law permits emergency contracting without competitive solicitation per IC 5- 22-10-4 and IC 36-1-12-0.1 but requires a memo be submitted to the Board documenting the justifying condition. In consultation with City Legal, having no heat in the part of this building that supplies water and sewer to Weather Amnesty is considered an emergency condition, and we have therefore contracted with EJ White in the amount of $50,219. Two quotes were solicited, with EJ White being the low bid.
