CITY OF SOUTHBEND <br />COMMUNITY INVESTMENT <br />January 7, 2020 <br />Dear Members of the Board of Public Works, <br />The week end after Christmas, DCI's property inspector Jeff Young checked the former Salvation <br />Army building to make sure it was secure and the mechanicals were functioning properly. He <br />noticed the southern two story section of the building was cold and checked the boiler, which had <br />overheated and was no longer operating. This two story section supplies the one story northern <br />section its water supply and sewer line, so it must be heated. The northern section currently houses <br />the City's Weather Amnesty program, and not having water or sewer service endangers the life <br />and health of the people the Weather Amnesty program serves during the coldest months of the <br />year. <br />Jeff contacted EJ White to inspect the boiler, and it was discovered sediment in the system had <br />clogged valves and overheated the system to the point the entire system needs replaced. <br />Section 14.5-6 of the Municipal Code (the Inclusive Procurement and Contracting ordinance) <br />allows for emergency contracting conditions, defined in Section 14.5-2(q) as "a contract that is <br />awarded on an emergency basis due to a threat of harm to person or property or threat of disruption <br />of government services." <br />Additionally, State law permits emergency contracting without competitive solicitation per IC 5- <br />22-10-4 and IC 36-1-12-0.1 but requires a memo be submitted to the Board documenting the <br />justifying condition. <br />In consultation with City Legal, having no heat in the part of this building that supplies water and <br />sewer to Weather Amnesty is considered an emergency condition, and we have therefore <br />contracted with EJ White in the amount of $50,219.
