ORDINANCE NO. 1 S ~~ ~~ .. <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING ARTICLE 2 OF CHAPTER 17 OF THE SOUTH BEND <br />MUNICIPAL CODE TO FIX RATES AND CHARGES FOR THE DISCHARGE OF <br />HAULED SEPTIC TANK WASTE AND SIMILAR HAULED LIQUID WASTES TO <br />THE SOUTH BEND WASTEWATER TREATMENT PLANT <br />STATEMENT OF PURPOSE AND INTENT <br />The purpose of this ordinance is to add a new Section 17-27.1 to Article 2 Chapter 17 of the <br />Municipal Code to revise the schedule of charges for hauled septic tank wastes and other similar <br />hauled liquid wastes to bring them into line with the other local treatment plants, both publicly and <br />privately owned, that receive hauled septic tank wastes. <br />The City of South Bend previously adopted a rate for hauled septic tank waste in 1973 (which <br />was not inserted in the Municipal Code) which averages about two and one-half cents ($0.025)per <br />gallon. At other local facilities, the average rate is about six cents ($0.06) per gallon. Hauled septic <br />waste can cause operational problems to the City's wastewater facility through plugging plant filter <br />screens. It is, therefore, necessary to increase the rate at the South Bend facility to be comparable <br />with other providers so that South Bend is not the most economically attractive site for hauled septic <br />tank and other liquid waste. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA AS FOLLOWS: <br />Section I. Chapter 17, Article 2, Division 4 of the South Bend Municipal Code is amended <br />to add a new Section 17-27.1 to read as follows: <br />Sec. 17-27.1. Hauled Septic Tank Waste and Similar Liquid Waste Discharge Requirements <br />and Rates <br />(a) Generally. Hauled septic tank waste and similar liquid waste is amenable to <br />treatment at the South Bend Wastewater Treatment Plant. Only hauled septic tank waste from <br />residential locations will be accepted. Hauled septic waste from industrial and commercial locations <br />is prohibited. <br />(b) Permitting Requirements. Any septic tank waste hauler must have a valid permit <br />issued by the State of Indiana, Department of Environmental Management in order to discharge at <br />the South Bend Wastewater Treatment Plant. In addition, each septic tank waste hauler must <br />complete a discharge application with the City of South Bend, Division of Environmental Services <br />prior to receiving approval to discharge at the South Bend Wastewater Treatment Plant. <br />
