The Area Plan Commission at its public hearing on March 21, 1995, <br /> took the following action: <br /> Upon a motion by Bruce Huntington, being seconded by Joseph Serge and unanimously <br /> carried, the proposed ordinance and site development plan of South Bend Heritage <br /> Foundation and South Bend Redevelopment Commission to zone from "B" Residential <br /> and "C" Commercial, "A" and "B" Height and Area to "B" Residential, "C" Height <br /> and Area, property located on the east side of the 1200 block of Fellows St., <br /> south side of the 500 block of Wenger St., west side of the 1200 block of Rush <br /> Street, and both sides of the 500 block of Pennsylvania Avenue, City of South <br /> Bend is sent to the Common Council with a favorable recommendation, subject to a <br /> final site development plan. The majority of the property is presently zoned "B" <br /> Residential with a portion in the northwest corner zoned "C" Commercial. Since <br /> the surrounding area is predominantly zoned "B" Residential, this petition would <br /> not create adverse impacts, but rather would help to revive the neighborhood in <br /> which it is located. The change to "C" Height and Area is required to allow <br /> duplex apartments to be placed on the site as specified on the Site Plan without <br /> having to obtain setback variances on each parcel. In the Commission's opinion, <br /> the proposed rezoning is appropriate and will have a substantial positive effect <br /> on the neighborhood. <br /> PLEASE NOTE that the Ordinance has been amended by the petitioner and is <br /> different than that used for the Common Council's first reading.
