UV U PS- <br /> AN ORDINANCE OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, APPROVING <br /> THE SALE OF PARK PROPERTY <br /> STATEMENT OF PURPOSE AND INTENT <br /> The City of South Bend, Indiana, for the use and benefit of <br /> its Park Department and/or Board of Park Commissioners <br /> (hereinafter, the "Park Department") owns certain real property <br /> located at Sample-Ewing Development Area, and being more <br /> particularly described below, (hereinafter, the "Real Property") . <br /> Pursuant to I .C. 36-10-4-9 (a) , said lands are under the exclusive <br /> control of the Board of Park Commissioners of the Park District <br /> of the City of South Bend (hereinafter, the "Park Board") . <br /> The Real Property, land comprising Dean Johnson Park and <br /> other miscellaneous lots in an area designated by the South Bend <br /> Redevelopment Commission as the Sample-Ewing Development Area <br /> (SEDA) . The Real Property is no longer needed for park purposes . <br /> At its meeting of February 20, 1995, the Park Board <br /> determined that the Real Property is not required for park <br /> purposes and authorized the sale of the Real Property to the City <br /> of South Bend Department of Redevelopment for use in connection <br /> with redevelopment activities within the SEDA, including the <br /> clearance of land for a new juvenile detention facility. <br /> The Park Board and Redevelopment Commission have committed <br /> to cooperate in the development of plans to replace Dean Johnson <br /> Park with alternate park facilities in the SEDA. <br /> Pursuant to I .C. 36-11-1-3, Common Council approval of the <br /> Sale of the Real Property is required. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, INDIANA, AS FOLLOWS : <br /> Section I .
