RESOLUTION NO.57-2019 A RESOLUTION OF THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS ACCEPTING DELEGATION OF CONTRACTING AUTHORITY FROM THE CITY OF SOUTH BEND BOARD OF PUBLIC SAFETY WHEREAS, the City of South Bend Board of Public Works (the "Works Board") is a contracting body of the City of South Bend (the "City") that exists and operates pursuant to Ind. Code § 36-4-9-5 and Ind. Code § 36-9-6; and WHEREAS, the City of South Bend Board of Public Safety (the "Safety Board") exists and operates pursuant to Ind. Code § 36-4-9-5 and Ind. Code §36-8-3; and WHEREAS, pursuant to Ind. Code § 36-8-3-2, the Safety Board has exclusive control over all matters and property relating to the South Bend Police Department (the "SBPD") and the South Bend Fire Department (the "SBFD"); and WHEREAS, the Works Board, as the primary contracting body for the City, has extensive experience in reviewing and approving City contracts and other matters; and WHEREAS, the Safety Board desires to delegate contracting authority over matters and property of the SBPD and SBFD to the Works Board, for the purpose of facilitating the City's efficient provision and performance of public safety -related services; and WHEREAS, on December 18, 2019, the Safety Board adopted Resolution No. 54-2019 delegating revocable concurrent contracting authority over matters and property of the SBPD and SBFD to the Works Board. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS AS FOLLOWS: 1. The Works Board accepts the Safety Board's revocable delegation of concurrent contracting authority over matters and property of the SBPD and SBFD. 2. The Works Board acknowledges that the Safety Board's revocable delegation of concurrent contracting authority over matters and property of the SBPD and SBFD shall not act to terminate or limit in any way the Safety Board's continuing control over all matters and property of the SBPD and SBFD. This Resolution will be in full force and effect upon its adoption. (Signatures on the following page)
