RESOLUTION NO.57-2019 <br />A RESOLUTION OF THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS <br />ACCEPTING DELEGATION OF CONTRACTING AUTHORITY FROM THE CITY <br />OF SOUTH BEND BOARD OF PUBLIC SAFETY <br />WHEREAS, the City of South Bend Board of Public Works (the "Works Board") is a <br />contracting body of the City of South Bend (the "City") that exists and operates pursuant to Ind. <br />Code § 36-4-9-5 and Ind. Code § 36-9-6; and <br />WHEREAS, the City of South Bend Board of Public Safety (the "Safety Board") exists <br />and operates pursuant to Ind. Code § 36-4-9-5 and Ind. Code §36-8-3; and <br />WHEREAS, pursuant to Ind. Code § 36-8-3-2, the Safety Board has exclusive control over <br />all matters and property relating to the South Bend Police Department (the "SBPD") and the South <br />Bend Fire Department (the "SBFD"); and <br />WHEREAS, the Works Board, as the primary contracting body for the City, has extensive <br />experience in reviewing and approving City contracts and other matters; and <br />WHEREAS, the Safety Board desires to delegate contracting authority over matters and <br />property of the SBPD and SBFD to the Works Board, for the purpose of facilitating the City's <br />efficient provision and performance of public safety -related services; and <br />WHEREAS, on December 18, 2019, the Safety Board adopted Resolution No. 54-2019 <br />delegating revocable concurrent contracting authority over matters and property of the SBPD and <br />SBFD to the Works Board. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND BOARD <br />OF PUBLIC WORKS AS FOLLOWS: <br />1. The Works Board accepts the Safety Board's revocable delegation of concurrent <br />contracting authority over matters and property of the SBPD and SBFD. <br />2. The Works Board acknowledges that the Safety Board's revocable delegation of <br />concurrent contracting authority over matters and property of the SBPD and SBFD shall not act <br />to terminate or limit in any way the Safety Board's continuing control over all matters and <br />property of the SBPD and SBFD. <br />This Resolution will be in full force and effect upon its adoption. <br />(Signatures on the following page) <br />
