(1) Issue a warning notice to the violator <br /> stating that he is in violation, that he has seven (7) days in <br /> which to apply for a license or correct the violation and that <br /> failure to do so may result in a citation being issued for the <br /> violation; or <br /> (2) Request that a citation be issued to the <br /> violator imposing a fifty dollar ($50 . 00) fine. Each <br /> subsequent day of violation shall be considered a separate <br /> offense for which a citation may be issued; or <br /> (3) Seek injunctive relief and/or monetary <br /> penalties . <br /> (b) The warning notice issued under this chapter <br /> shall contain the date, time, name and address of the <br /> violator, the Code section violated, nature of the violation, <br /> location of the violation, the name of the officer issuing the <br /> warning notice and the telephone number of the office to <br /> contact for information. <br /> (c) The citation issued under this chapter shall <br /> contain the date, time, name and address of the violator, the <br /> code section violated, the nature of the violation, location <br /> of the violation, the name of the officer issuing the citation <br /> and instructions as to disposition of the citations. <br /> SECTION II . Section 4-16 of the South Bend Municipal <br /> Code shall be and hereby is amended to read as follows : <br /> Sec. 4-16. Refusal to issue; suspension or revocation of <br /> licenses. <br /> (a) The City Controller may refuse to issue a <br /> license and any license issued pursuant to this Code may be <br /> suspended or revoked by the City Controller after rcaconablc <br /> written notice and hearing for any cause provided in Article <br /> 4 of this Chapter 4 pertaining to specific business <br /> regulations, or for any of the following causes : <br /> (1) Any fraud, material misrepresentation or <br /> false statement contained in application for license; <br /> (2) Any fraud, material misrepresentation or <br /> false statement made in connection with the selling of goods, <br /> wares, merchandise and services; <br /> (3) Any willful violation of a term or <br /> condition of a license; <br /> (4) Any willful activity in violation of a <br /> statute or provision of this Code related to the licensed <br /> business; <br />
