In order to utilize this LOU, the Employer shall submit a written request to do so to the Union in <br />advance of bidding the project. The submission by the Employer shall include a detailed <br />justification for why the Employer believes applying the LOU to the project in question will <br />advance the twin goals of making the Employer more competitive and creating jobs for Local <br />142 members. The Employer's request shall list each and every anticipated non -union contractor <br />bidding against the Employer on the project. <br />The Union shall review requests to apply the LOU on a project -by -project basis and, in its sole <br />discretion may approve use of the LOU on a particular project. The Union shall provide the <br />Employer written notice of its approval (which approval shall not be unreasonably withheld) or <br />rejection of the Employer's request prior to bid. <br />The Union may cancel this LOU as to a particular Employer if in its sole judgment the Union <br />believes that said Employer has violated or abused the LOU. The Union shall provide the <br />Employer of written notice of the cancellation. Provided further, should a difference of opinion <br />arise pertaining to work covered by this LOU, the parties agree to meet as soon as possible in an <br />attempt to resolve the difference of opinion. <br />In order to be eligible to utilize this LOU, the Employer must be current on all fringe benefit <br />payments at the time of bid. <br />It is agreed that this Letter of Understanding shall be sub .iect to review on or before June 1 st of <br />each year by the joint Employer/Union Bargaining Committee for the purpose of determining the <br />value and effectiveness of this LOU. If it is determined by either Party that this LOU has not <br />been effective in making the signatory contractors more competitive in the market place and <br />produced more employment for the members of Local No. 142, then the Parties agree that they <br />will engage in bargaining over possible revisions of the LOU for the purpose of making it more <br />effective or it may be cancelled as of June 1 st of each year.
