ORDINANCE NO. w <br /> AN ORDINANCE AMENDING ORDINANCE NO. 6738-80 <br /> TO CORRECT THE LEGAL DESCRIPTION OF THE REAL ESTATE <br /> LOCATED AT 830 N. MICHIGAN STREET, IN THE <br /> CITY OF SOUTH BEND, INDIANA, WHICH WAS THEREBY <br /> DESIGNATED AND ESTABLISHED AS A HISTORIC LANDMARK <br /> WHEREAS, on January 28, 1980 the Common Council adopted <br /> Ordinance No. 6738-80 which amended the Zoning Ordinance of the <br /> City of South Bend to designate and establish a historic landmark <br /> for real property located at 830 North Michigan Avenue, South <br /> Bend, Indiana, commonly known as the North Michigan Pumping <br /> Station and Well Field, and <br /> WHEREAS, the legal description of the North Michigan Pumping <br /> Station and Well Field set forth in Ordinance No. 6738-80 is <br /> incorrect and this Ordinance will correct that error. <br /> BE IT THEREFORE ORDAINED BY THE COMMON COUNCIL OF THE CITY <br /> OF SOUTH BEND, INDIANA: <br /> Section 1 . The legal description of the North Pumping <br /> Station and Well Field which was designated as a historic <br /> landmark on January 28, 1980 under Ordinance No. 6738-80 is <br /> corrected, amended and set forth as follows: <br /> Commencing at a four inch cast iron pipe three and one half <br /> feet in length set 8 7/10ths feet north of the Southwest <br /> corner of Lot Number 20 in Rockstroh Brothers Sub-division <br /> of a part of Out Lots Number 126, 127, 128 and 129 in the <br /> Third Plat of Bank Out Lots platted by the State Bank of <br /> Indiana, thence east at right angles with the east line of <br /> Michigan Street 606 feet to the westerly bank of the St . <br /> Joseph River, thence North Westerly with the bank of said <br /> river to the East line of Michigan Street, thence South <br /> along the east line of said street to the place of <br /> beginning, containing five acres more or less, and also the <br /> island lying within the St . Joseph River, northeasterly and <br /> opposite the tract herein conveyed, first above described. <br /> Section 2 . This amendatory Ordinance shall be in full force <br /> and effect from and after its passage by the Common Council, <br /> approval by the Mayor and Legal publication. <br /> /11- <br /> Member of the Common C uncil <br />
