ORDINANCE NO. gQ-9 <br /> 6 <br /> AN ORDINANCE OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, APPROVING <br /> THE SALE OF PARK PROPERTY <br /> STATEMENT OF PURPOSE AND INTENT <br /> The City of South Bend, Indiana, for the use and benefit of <br /> its Park Department and/or Board of Park Commissioners <br /> (hereinafter, the "Park Department") owns certain real property <br /> located in the 900 block of West LaSalle Street, and being more <br /> particularly described as follows : <br /> Lot Numbered Fifty-nine (59) as shown on the recorded <br /> Plat of Cobb' s Subdivision of Bank Out Lot Numbered <br /> Thirty (30) of the First Plat of Out Lots of the Town, <br /> now City of South Bend, as platted by the State Bank of <br /> Indiana, recorded in Plat Book 2, page 20, in the <br /> Office of the Recorder of St . Joseph County, Indiana, <br /> (hereinafter, the "Real Property") . Pursuant to I .C. 36-10-4- <br /> 9 (a) , said lands are under the exclusive control of the Board of <br /> Park Commissioners of the Park District of the City of South Bend <br /> (hereinafter, the "Park Board") . <br /> The Real Property is located on West LaSalle Street within <br /> an area being revitalized by the South Bend Heritage Foundation, <br /> a non-profit corporation. The property is equipped with certain <br /> pieces of playground equipment, but is no longer needed for park <br /> purposes . <br /> At its meeting of February 19, 1996, the Park Board <br /> determined that the Real Property is not required for park <br /> purposes and authorized the sale of the Real Property upon the <br /> following conditions : <br /> A. That the Real Property be transferred to the South <br /> Bend Heritage Foundation for the sum of One Dollar ($1 . 00) <br /> for use in its West LaSalle Street revitalization project . <br /> B. That the playground equipment located at the Real <br /> Property be relocated by South Bend Heritage Foundation to a <br /> location serving an eligible South Bend neighborhood. <br /> Pursuant to I .C. 36-11-1-3, Common Council approval of the <br /> Sale of the Real Property is required. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, INDIANA, AS FOLLOWS : <br /> Section I . The disposal of the Real Property is approved, <br /> subject to the following conditions : <br /> A. That the Real Property be transferred to the South <br /> Bend Heritage Foundation for the sum of One Dollar ($1 . 00) <br /> for use in its West LaSalle Street revitalization project . <br /> B. That the playground equipment located at the Real <br /> Property be relocated by South Bend Heritage Foundation to a <br /> location serving an eligible South Bend neighborhood. <br />
