(xx) Wild animals means any animal not a domestic or exotic <br /> animal, with the exception of small, nonpoisonous aquatic or <br /> amphibious animals and small cage birds, which are normally found <br /> in a wild state. <br /> (yy) Zoological park means any facility, other than a pet <br /> shop or kennel displaying or exhibiting one or more species of <br /> nondomesticated animals operated by a person, partnership, <br /> corporation or governmental agency and is properly zoned for such <br /> use which possesses valid permits as required under state and <br /> federal law. <br /> Sec. 5-2. Reserved. <br /> SECTION II . Chapter 5, Article 2, of the South Bend <br /> Municipal Code shall be, and hereby is, amended to read as <br /> follows : <br /> Sec. 5-3. Establishment and duties of the animal control <br /> commission. <br /> The Animal Control Commission is established and shall have <br /> the following duties : <br /> (a) To report to or be responsible to the Mayor and the <br /> Common Council . <br /> (b) To recommend proposed policies, principles, standards <br /> and regulations for the control and humane treatment of all <br /> animals in the City. <br /> (c) To review and to make recommendations on the improved <br /> enforcement of the terms of this chapter and to the Common <br /> Council as to ordinances necessary for the care and treatment of <br /> all animals of this chapter. <br /> (d) To review the performance of any agency hired by the <br /> City, and agencies of the City in any matter related to the <br /> enforcement of this chapter. <br /> (e) To receive reports involving animal control from the <br /> Humane Society, Police Department, Code Enforcement Department, <br /> and Street Department involving animal control, or other agency <br /> authorized to carry out the provisions of this Chapter. <br /> (f) To submit to the Mayor and Common Council no later than <br /> March 1st of each year a written report of its activities and <br /> recommendations . <br /> 8 <br />
