Ordinance No. l s Zg <br />AN ORDINANCE OF THE COMMON COUNCIL <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />TO AMEND VARIOUS ARTICLES OF <br />CHAPTER 6, BUILDING, OF THE SOUTH BEND <br />MUNICIPAL CODE ADDRESSING BUILDING <br />CODES AND PERMIT FEES <br />STATEMENT OF PURPOSE AND INTENT <br />On December 31, 1991, the City of South Bend and the County of St. Joseph entered into an <br />agreement to merge their building departments; and further created the "Consolidated Building Board" . <br />In 1993, by Ordinance No. 8412-93 subsection 1, the Board created the Building Department as an <br />enterprise fund. <br />It has been determined that in order to maintain the enterprise fund, a fee increase would be <br />needed as set forth in this ordinance. Furthermore, the State of Indiana has revised the building codes to <br />be followed by the State and local jurisdictions. <br />Now, therefore, be it ordai~:ed by the Common Council of the City of South Bend, Indiana, as <br />follows: <br />Section 1. Chapter 6, Article I, Section 6-4(b)(1) shall be amended as follows: <br />(1) The fee for permits issued for new construction and building additions shall be <br />based upon the square footage of such new construction or addition at the rate of °~° ^°^*° yen n~` e <br />cents ($0.08) per square foot for the first one hundred thousand (100,000) square feet and <br />x$9:94) six cents ($0.06) per square foot for each additional square foot, with a minimum permit fee of <br />$20.00. <br />Section 2. Chapter 6, Article I, Section 6-4(b)(11) shall be amended as follows: <br />(11) The fee for installation of a wood burning stove shall be ~'~°°~ a~"^r~ ~~' c nn <br />twenty dollars ($20.00) per flue (including chimney and chimney connector). <br />Section 3. Chapter 6, Article 2, Section 6-5(a) shall be deleted in its entirety and replaced as <br />follows: <br />(a) Pursuant to IC 22-13-2-3(B), the rules of the Indiana Fire Prevention and Building Safety <br />Commission as set out in the following Articles of Title 675 of the Indiana Administrative Code are <br />hereby incorporated by reference in this code and shall include any later amendments to those rules. <br />
