REGULAR MEETING NOVEMBER 12, 2019 344 <br />Mr. Gilot indicated that Mr. Ziola Morocho, 436 N. Brookfield St., South Bend, IN, has <br />submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Street <br />Department, Fire Department, Police Department, and Engineering Department. He noted <br />Community Investment stated the vacation would hinder the use of a public right-of-way by a <br />neighborhood in which it is located or to which it is contiguous, thereby violating the criteria of <br />I.C. 36-7-3-13 regulating vacations. Therefore, Ms. Maradik made a motion for an unfavorable <br />recommendation of the request for vacation. Ms. O'Sullivan seconded the motion which carried. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE THE EAST/WEST <br />ALLEY FROM MAIN ST. TO MICHIGAN ST., SOUTH OF SAMPLE ST AND NORTH OF <br />GARST ST. <br />Mr. Gilot indicated that Mr. David Farhan, Shark Investments, LLC, 922 Main St., South Bend, <br />IN has submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Fire <br />Department and Police Department. He noted Community Investment and Engineering stated the <br />vacation would make access to the lands of the aggrieved person by means of public way <br />difficult or inconvenient and would hinder the use of a public right of way by a neighborhood in <br />which it is located or to which it is contiguous, thereby violating the criteria of I.C. 36-7-3-13 <br />regulating vacations. Therefore, Ms. Maradik made a motion for an unfavorable recommendation <br />of the request for vacation. Ms. O'Sullivan seconded the motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Maradik, seconded by Ms. O'Sullivan and carried, the following <br />traffic control device requests were approved: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATIONS: 2910 Prast Blvd. <br />1513 Johnson St. <br />REMARKS: All Criteria has been met <br />APPROVE CONSENTS TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of the following Consents to Annexation and <br />Waivers of Right to Remonstrate. The Consents indicate that in consideration for permission to <br />tap into public water/sanitary sewer system of the City, to provide water/sanitary sewer service <br />to the below referenced properties, the applicants waive and release any and all rights to <br />remonstrate against or oppose any pending or future annexations of the properties by the City of <br />South Bend: <br />A. Westview Capital, LLC: <br />1. 20260 Kiefer Way— Water/Sewer (Key #002-1004-008001) <br />2. 51789 Hannigan Dr. — Water/Sewer (Key #002-1004-008054) <br />B. FRL Construction, 52620 East Tr. — Water/Sewer (Key #021-1036-059309) <br />Upon a motion by Ms. Maradik, seconded by Ms. O'Sullivan and carried, the Consents to <br />Annexation and Waivers of Right to Remonstrate were approved as submitted. <br />RATIFY APPROVAL AND/OR RELEASE CONTRACTOR, EXCAVATION. AND <br />OCCUPANCY BONDS <br />The Division of Engineering Permit Department recommended that the following bonds be <br />ratified pursuant to Resolution 100-2000 and/or released as follows: <br />A. Contractor Bonds <br />1. Jhonny Pineda dba On the Spot Services, Approved Effective October 23, <br />2019 <br />2. KWEST Group, LLC. Approved Effective October 17, 2019 <br />3. John Ward Concrete, Inc. Approved Effective November 1, 2019 <br />B. Excavation Bonds <br />1. Electric Conduit Construction Company. Approved Effective October 18, <br />2019 <br />2. R Gordon Engineering, Inc. Approved Effective October 24, 2019 <br />
