The staff of the City of South Bend, Department of Public Works shall be, and <br />hereby are, authorized to prepare and present to the Mayor and the Clerk of the City quit claim <br />deeds transferring the City's interests in the Property described at Exhibit A. <br />3. Martin, Clerk <br />ADOPT RESOLUTION NO. 49 -2012 — ACCEPTING THE TRANSFER OF REAL <br />PROPERTY FROM NEAR NORTHWEST NEIGHBORHOOD INC. <br />Upon a motion made by Mr. Inks, seconded by Ms. Roos and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO. 49-2012 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA <br />ACCEPTING THE TRANSFER OF REAL PROPERTY FROM <br />NEAR NORTHWEST NEIGHBORHOOD, INC. <br />WHEREAS, the Near Northwest Neighborhood, Inc. ( "NNN ") is a nonprofit entity <br />organized under the laws of the State of Indiana for the purpose of developing and rehabilitating <br />property located within the City of South Bend, Indiana, and is the owner of the following <br />described real property situated in St. Joseph County, Indiana: <br />See Exhibit A attached <br />(hereinafter referred to as the "Real Property "), and; <br />WHEREAS, the City of South Bend, Indiana ( "City "), acting by and through the Board <br />of Public Works, hereby expresses its desire to acquire Real Property from UEA; and <br />WHEREAS, NNN desires to transfer the Real Property to the City; and <br />WHEREAS, pursuant to I. C. 3 6- 1- 11 -1(b) (7), City may exchange or transfer property <br />with an Indiana nonprofit corporation upon terms and conditions agreed upon by the two (2) <br />entities as evidenced by the adoption of substantially identical resolutions of each entity. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />1. The transfer of the Real Property situated in St. Joseph County, Indiana, and generally <br />described as follows: <br />See Exhibit A attached <br />
