(I) Are comprised of parcels that are either unimproved or <br /> contain only one (1) or two (2) family dwellings or <br /> multifamily dwellings designed for up to four (4) <br /> families, including accessory buildings for those <br /> dwellings; and <br /> (II) Have dwellings which are not permanently occupied and <br /> are: <br /> (i) the subject of an order issued under Indiana Code <br /> §36-7-9; or <br /> (III) Have parcels of property in the area which: <br /> (i) have been sold and not redeemed under Indiana Code <br /> §6-1 . 1-24 and Indiana Code §6-1 . 1-25; or <br /> (ii) are owned by a unit of local government; <br /> or are found in the alternative to: <br /> (I) Have a significant number of dwelling units within the <br /> area which are not permanently occupied or have a <br /> significant number of parcels in the area which are <br /> vacant land; and <br /> (II) Have a significant number of dwelling units within the <br /> area which are: <br /> (i) the subject of an order issued under Indiana Code <br /> §36-7-9; or <br /> (ii) evidence significant building deficiencies; and <br /> (III) Have experienced a net loss in the number of dwelling <br /> units, as documented by census information, local <br /> building and demolition permits, or certificates of <br /> occupancy, or the area is owned by Indiana or the United <br /> States; and <br /> The RDAs designated herein (plus any areas previously <br /> designated under Indiana Code §6-1 . 1-12 .1-2) will not exceed ten <br /> percent (10%) of the total area within the Council' s jurisdiction. <br /> SECTION II . Chapter 2, Article 6, Section 2-77 . 1 entitled <br /> "Single-family Construction" of the South Bend Municipal Code shall <br /> be amended by the addition of the additional language: <br /> (c) The grant of a residentially distressed area <br /> designation is subject to the following conditions : <br /> (1) The deduction will not be allowed unless the <br /> dwelling is rehabilitated to meet the local code <br /> standards for habitability. <br /> (2) If a designation application is filed, the <br /> Council may require that the redevelopment or <br /> rehabilitation is completed within a reasonable <br /> period of time. <br /> SECTION III . Ordinance No. 8668-96 passed by the South Bend <br /> Common Council on April 15, 1996, is hereby repealed. <br />
