Amend Code Chapter 2 Article 6 Tax Abatement Procedures Repealing Ordinance # 8668-96

(I) Are comprised of parcels that are either unimproved or contain only one (1) or two (2) family dwellings or multifamily dwellings designed for up to four (4) families, including accessory buildings for those dwellings; and (II) Have dwellings which are not permanently occupied and are: (i) the subject of an order issued under Indiana Code §36-7-9; or (III) Have parcels of property in the area which: (i) have been sold and not redeemed under Indiana Code §6-1 . 1-24 and Indiana Code §6-1 . 1-25; or (ii) are owned by a unit of local government; or are found in the alternative to: (I) Have a significant number of dwelling units within the area which are not permanently occupied or have a significant number of parcels in the area which are vacant land; and (II) Have a significant number of dwelling units within the area which are: (i) the subject of an order issued under Indiana Code §36-7-9; or (ii) evidence significant building deficiencies; and (III) Have experienced a net loss in the number of dwelling units, as documented by census information, local building and demolition permits, or certificates of occupancy, or the area is owned by Indiana or the United States; and The RDAs designated herein (plus any areas previously designated under Indiana Code §6-1 . 1-12 .1-2) will not exceed ten percent (10%) of the total area within the Council' s jurisdiction. SECTION II . Chapter 2, Article 6, Section 2-77 . 1 entitled "Single-family Construction" of the South Bend Municipal Code shall be amended by the addition of the additional language: (c) The grant of a residentially distressed area designation is subject to the following conditions : (1) The deduction will not be allowed unless the dwelling is rehabilitated to meet the local code standards for habitability. (2) If a designation application is filed, the Council may require that the redevelopment or rehabilitation is completed within a reasonable period of time. SECTION III . Ordinance No. 8668-96 passed by the South Bend Common Council on April 15, 1996, is hereby repealed.
