REGULAR MEETING AUGUST 27, 2012 <br /> <br /> <br /> <br />PUBLIC HEARINGS <br /> <br /> <br />BILL NO. 39-12 PUBLIC HEARING ON A BILL OF THE <br />COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AMENDING THE LEGAL <br />DESCRIPTION OF ORDINANCE NO. 10165-12 <br />WHICH IDENTIFIED THE BOUNDARIES OF A <br />RIVERFRONT DEVELOPMENT PROJECT <br />AREA UNDER INDIANA CODE 7-3-20-16 <br /> <br />Council Attorney Kathleen Cekanski-Farrand advised that the Indiana Code Section in <br />the title of the bill was incorrect. She advised that it should read 7.1-3-20-16. <br /> <br />Councilmember Oliver Davis made a motion to correct the title. Councilmember Scott <br />seconded the motion which carried by a voice vote of eight (8) ayes. <br /> <br />Aaron Perri, Executive Director, Downtown South Bend, Inc., 217 South Michigan <br />Street, South Bend, Indiana made the presentation for this bill. <br /> <br />Mr. Perri advised that on June 25, 2012 the South Bend Common Council passed <br />Ordinance No. 10165-12 which identified the boundaries of a Riverfront Development <br />Project. It was recently discovered that due to a scrivener’s error tat real estate located at <br />301 and 305 South Michigan Street were not included in the legal description in “Exhibit <br />B” in that Ordinance. This bill would rectify that legal description oversight. <br /> <br />This being the time heretofore set for the Public Hearing on the on the above bill, <br />proponents and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Ferlic made a motion for favorable <br />recommendation to full Council concerning this bill as amended.
