ORDINANCE NO. g <br /> AN ORDINANCE OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> APPROVING THE SALE OF PARK PROPERTY <br /> STATEMENT OF PURPOSE AND INTENT <br /> The City of South Bend, Indiana, for the use and benefit of <br /> its Park Department and/or Board of Park Commissioners <br /> (hereinafter, the "Park Department") owns certain real property <br /> bordering the former Calvert Street between Rush Street and High <br /> Street (hereinafter, the "Real Property") . Pursuant to I.C. 36-10- <br /> 4-9 (a) , said land is under the exclusive control of the Board of <br /> Park Commissioners of the Park District of the City of South Bend <br /> (hereinafter, the "Park Board") . <br /> The Park Board has previously transferred property north of <br /> Calvert Street to the South Bend Community School Corporation <br /> (hereinafter, the "SBCSC") for use in the construction of the new <br /> Riley High School. <br /> Calvert Street, from Rush Street to High Street, was vacated <br /> by the South Bend Common Council, in Ordinance 8707-96, on August <br /> 12, 1996. Upon said vacation, the Park Department acquired, by <br /> operation of law, the southern half of the former Calvert Street, <br /> bordering the Studebaker Golf Course, more particularly described <br /> as follows: <br /> Commencing at the Northeast corner of now vacated East <br /> Calvert Street and South Rush Street, being the Point of <br /> Beginning; thence South 30 feet along the East right-of- <br /> way line of South Rush Street to the Centerline of <br /> vacated Calvert Street; thence East approximately 898 <br /> feet along the centerline of vacated Calvert Street to <br /> the West right-of-way line of South High Street; thence <br /> North 30 feet to the North right-of-way of vacated <br /> Calvert Street; thence West along the North right-of-way <br /> line approximately 898 feet to the Point of Beginning. <br /> Part situated in Henry Studebaker Park and South East <br /> Addition to the City of South Bend, Indiana. <br /> At its meeting of September 24, 1996, the Park Board <br /> determined that the aforementioned property is not required for <br /> park purposes and authorized the sale of Real Property bordering <br /> the former Calvert Street between Rush Street and High Street to <br /> the SBCSC. <br /> Pursuant to I .C. 36-10-4-18, once the Park Board has <br /> determined that land under its control is no longer needed for park <br /> purposes, the Common Council shall determine whether to approve the <br /> sale of such land. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br /> Section I . The sale of the southern half of the previously <br /> vacated Calvert Street, between Rush Street and High Street, as <br /> described hereinabove, is approved. <br />
