RESOLUTION NO.44-2019 <br />A RESOLUTION OF THE CITY OF SOUTH BEND INDIANA <br />BOARD OF PUBLIC WORKS FOR THE <br />DISPOSAL OF SURPLUS PROPERTY <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the <br />right and duty to have custody of, control of, use of, and dispose of in accordance with Indiana <br />statutes, all real and personal property owned by the City of South Bend (the "City"); and <br />WHEREAS, I.C. § 5-22-22-1 permits and establishes procedure for disposal of personal <br />property which is no longer needed by the City or which is unfit for the purpose for which it was <br />intended; and <br />WHEREAS, I.C. § 5-22-22-8 states that personal property may be deemed worthless if the <br />sale or transportation of such personal property would cost more than its value and allows for the <br />disposition of such personal property at the discretion of the City; and <br />WHEREAS, seven (7) modular buildings were transferred to the Board of Public Works <br />by Ivy Technical Community College pursuant to the Modular Building Transfer Agreement made <br />on February 27, 2018 (the "Property"); and <br />WHEREAS, the Property was intended to be used in connection with a gateway center to <br />help homeless individuals transition into permanent housing; and <br />WHEREAS, the Property was placed on a parcel of vacant real estate owned by the City's <br />Redevelopment Commission until a suitable location for the gateway center was determined; and <br />WHEREAS, during the time in which the Property has been stored, it has been vandalized <br />and become deteriorated beyond usefulness for its intended purpose; and <br />WHEREAS, the City's strategy for transitional housing no longer includes the utilization <br />of the Property; and <br />WHEREAS, City staff has contacted potential purchasers or donees for the Property and <br />also determined that the cost of transporting or repairing the Property would substantially exceed <br />its value; and <br />WHEREAS, Unity of Michiana, Inc., an Indiana nonprofit corporation, has agreed to <br />accept the transfer of one (1) of the modular buildings; and <br />WHEREAS, the City wishes to dispose of the remaining six (6) modular buildings. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of <br />South Bend that the Property is no longer needed by the City, is unfit for the purpose for which it <br />was intended, and has an estimated fair market value of Zero Dollars ($0.00); and <br />BE IT FURTHER RESOLVED that one (1) modular building be provided to Unity of <br />
