ORDINANCE NO. ?-777- <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, SETTING THE ANNUAL SALARIES <br /> FOR THE MAYOR AND FOR THE CITY CLERK FOR <br /> CALENDAR YEAR 1997 <br /> STATEMENT OF PURPOSE AND INTENT <br /> Pursuant to Indiana Code § 36-4-7-2, the City' s legislative <br /> body is required to fix the annual compensation of all elected <br /> officers . Such compensation may "not be changed in the year for <br /> which it is fixed, nor may it be reduced below the amount fixed for <br /> the previous year" . <br /> The following Ordinance establishes the annual compensation <br /> for Mayor of the City of South Bend and for the South Bend City <br /> Clerk for calendar year 1997 by freezing the same at the 1996 <br /> level . <br /> NOW, THEREFORE, be it ordained by the Common Council of the <br /> City of South Bend, Indiana, as follows : <br /> Section I . The annual compensation for the Mayor of the City <br /> of South Bend in calendar year 1997 shall be and hereby is <br /> established at $68, 250 . 00 . <br /> Section II . The annual compensation for the South Bend City <br /> Clerk in calendar year 1997 shall be and hereby is established at <br /> $36, 972 . 00 . <br /> Section III . If any one or more of the provisions contained <br /> in this ordinance shall for any reason be held to be invalid, <br /> illegal, or unenforceable in any respect, such invalidity, <br /> illegality or unenforceability shall not affect any other provision <br /> hereof, and this ordinance shall be construed as if such invalid, <br /> illegal or unenforceable provision was not contained therein. <br /> Section IV.
