54T <br />The Board r:let in regular session 9t 10:00 A* 14, All members present. <br />Hearing given on Declaratory Resolution for paving of Prairie Ave. under_ Imp- <br />rovement Resolution No. 629.` All remonstrances were over -ruled. <br />Engineer tiled estimated cost as follows: <br />(Nw,ie of street) (kAnd of improvement) (Cost) <br />Prairie Ave. P�,vemer�G <br />1do other remonstrantors sppeared and no other_ remonstrances were filed. All <br />other rer_ionstrances over -ruled. The Board therefore find in each and every case in said <br />improvements that the benefits to the property and to the City of South Bend are equal to <br />the estimated cost of said improvements and the sextie are hereby in all things ratified, <br />confirmed and approved., <br />Resolved, that notices be published on the 17th day of Dec. -and on the 24th day <br />af.Dee. 19092 in the South Bend Daily Times, stating that this Board will receive bids for <br />the construction of said improvement up to 10:00 A. M. ON the 311t day of December 1909, <br />Me Board reserves the right to reject any or all bids. <br />Remonstrances filed by D. D. St.; Cement sidewalk on Nrapier St. from Walnut St. to Cherry St,; <br />Grade, Curb & Walk.. on Fifth St. from Orange St. to Linden Ave. all under improvement Resol- <br />ut� ons 11os. 5 ,7, 5 -5, 595, 6032 6122 613 & .,16 respectively. <br />Assessment Roll for W. Wayne St. Pipe Sewer under Improvement Resolution No. 59-9 <br />was amended. No other remonstrances were filed. <br />'No remonstrators appeared and no remonstrances were filed. The Board therefor find <br />that the property assessed in said rolls lt'aftended filed Dec. 7, 19092 is benefitted in <br />the amount of assessments as amended as shown on said rolls, and the Board further find thtt <br />the assessment:- rolls filed Ded. 7, 1909, and the final estinate allowed Ded. 7: 3-9092 <br />should be hnd the same are hereby in all thin gs ratified, confirmed and approved as amended. <br />Engineer reported favorable <br />,+On'the Plan of the Central Union Telephone <br />io..• ;.:Serao approved by the Board. <br />Company for additional underground construct - <br />In the matter of Condemnation Resolution No. 53 for the opening of an alley from <br />Leer Street to Kline St, it is held that the benefits and damages are equal and that none of <br />the rerl estate mentioned in the assessment roll herein is especially benefitted or damaged <br />and the said assessment Roll is hereupon adopted. <br />It is further ordered that n6tice of Such awards of damages and assessments of <br />benefits be served by the Plice Department according to lave and that a hearing be had on the <br />31st day of December 1909 at 10:00 A. if. for the purpose of herring or receiving objections <br />from any person or persons interested in or affected by said matter. <br />Whereas this board did -heretofore enter into a certain contract for the leasing <br />of certain real estate on W. Sample Street in South Bend St. Joseph County, Indiana owned <br />by the James Oliver Estate , an accurate description of which real estate is as follows: <br />Beginning at the -center of Arnold Street extended South where the same intersects <br />the South line of Sample Street, thence East thirty (30) feet.,, thence South eight (90) feet, <br />thence West sixty (60) Peet, thence North eighty (90 feet, to the south line of Sample.
