Amending Chapter 2 Article 6 Tax abatement procedures

(I) have been sold and not redeemed under Indiana Code §6- 1.1 -24 and Indiana Code §6- 1.1 -25; or (ii) are owned by a unit of local government; or are found in the alternative to: (I) Have a significant number of dwelling units within the area which are not permanently occupied or have a significant number of parcels in the area which are vacant land; and (II) Have a significant number of dwelling units within the area which are: (I) the subject of an order issued under Indiana Code §36 -7 -9; or (ii) evidence of significant building deficiencies; and (III) Have experienced a net loss in the number of dwelling units, as documented by census information, local building and demolition permits, or certificates of occupancy, or the area is owned by Indiana or the United States; and The RDAs designated herein (plus any areas previously designated under Indiana Code §6 -1.1- 12.1 -2) will not exceed ten percent (10 %) of the total area within the Council's jurisdiction. SECTION II. Chapter 2, Article 6, Section 2- 77.1(b) entitled "New Construction" of the South Bend Municipal Code shall be amended in its entirety by the following language: (b) New Construction: Proposed single - family new construction homes which meet the requirements addressing residentially distressed areas set forth in I.C. 6 -1.1- 12.1 -2, may be considered for five -year real property tax abatement.
