5. NEW BUSINESS <br />a NAACP Remonstrance Suit: Commission Legal <br />Couns 1, Mr. Bruce C. Hammerschmidt, stated, for <br />the r cord, the Remonstrance Suit, filed by the <br />NAACP against the Central Downtown Urban Renewal <br />Proje t, R -66, has been voluntarily dismissed by <br />the remonstrators. As of last Friday, July 25, <br />1969, Cause No. D -8856 was filed with the St. <br />Joseph Superior Court by the remonstrators to <br />dismiss the action and the motion was granted. <br />The litigation is now conclusively terminated, <br />and, as a result, the Part II Application has <br />been submitted to Washington. <br />President Wiggins extended his thanks to Mr. <br />Hamme schmidt stating this is the good news we <br />have been waiting for some time, and that the <br />next step in the series of events in the Down- <br />town Project will be the approval of Part II by <br />the H D Office, in Washington, which is expected <br />in ap roximately four to six weeks. The acqui- <br />sitior appraisals will be submitted to HUD, in <br />Chica o, for their approval, within four to six <br />weeks and, upon HUD approval, acquisition can <br />begin First priority will be given to property <br />withi the post office area and those needed for <br />the n w street alignment. <br />Mrs. '" anet Allen stated she has been receiving <br />calls from property owners on L.W.E. regarding <br />whether or not she recommends improving the <br />properties to be acquired and whether the <br />property improvements will enhance the acqui- <br />sition value. President Wiggins stated that we <br />can give residents in that area, other than the <br />post office site area, assurance that we will <br />not have to acquire this property within this <br />building season. He also stated we have the <br />additional responsibility to these people for a <br />place to go and the moment we have Federal ap- <br />proval to buy these properties, we will find <br />accommodations for the displacees. <br />Mr. Glenn Barbe said the staff had the same <br />problem in the other projects and that normal <br />maintenance should continue to maintan the <br />prese t value of that structure.
