2,06 <br />Friday August 14th. 1909. <br />The Board met in regular session at 10.A. M. <br />All members present. <br />Petition filed by C. M. Wenger et. al. for an electric light at the corner of <br />Dale avenue & Broadway and for one at the corner of High street & Broadway. <br />Remonstrance filed by C. C. Shively, A. B. Shively et. al. against the May <br />street Grade, Curb & Walk Improvement. <br />Hearing given on Improvement'Resolution No. 509 for Pipe Sewer on Edward street <br />from Kemble avenue to Prairie avenue. The Board being advised in said matter find <br />that the remonstrance should be sustained and that all action under said resolution <br />is hereby RESCINDED. <br />Hearing on Condemnation Resolution No, 43 was deferred until September 4th, <br />1909, at 10 A. M.' <br />WHEREAS this Board heretofore condemned certain lands of C. M. Wenger and <br />Marietta Xreighbaum for the opening of South Carroll street, under Condemnation <br />Resolution No. 29, by which said parties were allowed a sum of $640.00 as net <br />benefits and <br />WHEREAS prior to said condemnation proceedings said parties had agreed to waive <br />all benefits on said proceedings, provided the City construct the Grade, Curb & Walk <br />on said Carroll street along said property without expense to said parties, wXhich <br />proposition was orally accepted by this Board and <br />WHEREAS said work of Grade, Curb & Walk has-been completed under Improvement <br />Resolution No. 491 and <br />- WHEREAS the assessments on said Condemnation Resolution No. 29 have been paid <br />into the Treasury and will be applied to payment of the assessment assumed by the <br />City as hereinset forth and <br />WHEREAS there remains an amount of $240.97 of said assessments in excess of the <br />amount realized from the Condemnation Resolution. It is hereby ordered that said <br />sum be paid from the Street Improvement appropriation of this board in full <br />settlent of the same. <br />o-o-o-o-oo- <br />Hearing on Declaratory Resolution No. 548 for Trunk Sewer on Meade, Huron <br />Olive streets was deferred until Wednesday September 2nd, 1905, at 10 a. m. <br />4# <br />President. <br />
